• 1. General. Except for those electing to pay Impact Fees pursuant to <br /> Section 3.18.040.C.2, Independent Fee Calculation Study, the <br /> Impact Fees applicable to the Impact-Generating Development <br /> shall be as determined by the Fee Schedule set forth in Appendix <br /> A: Impact Fee Schedule, which is hereby adopted and incorporated <br /> herein. The Impact Fee Schedule adopted in Appendix A is based <br /> on the Impact Fee Study. It applies to the broad class of land uses <br /> within the City, differentiates between types of land uses, and is <br /> intended to defray the projected impacts caused by proposed new <br /> development on City Municipal Capital Facilities, Library Capital <br /> Facilities, Transportation Capital Facilities, Parks and Trails <br /> Capital Facilities, and Recreation Capital Facilities. The <br /> determination of the land use category(ies) in the Impact Fee <br /> Schedule that is applicable to Impact-Generating Development <br /> shall be made by the City Planning Director or designee with <br /> reference to the Impact Fee Study and the methodologies therein; <br /> the then-current edition of the ITE Trip Generation Manual, 7t <br /> Edition, 2003, published by the Institute of Traffic Engineers; the <br /> City zoning code; the then-current land use approvals for the <br /> Development; the intent of this Chapter as set forth in Section <br /> 3.18.020, and any additional criteria set forth in administrative <br /> • rules adopted pursuant to this Chapter. <br /> Section 4. Appendix A of Chapter 3.18 of the Louisville Municipal Code, entitled <br /> Appendix A: Impact Fee Schedule, is hereby repealed and replaced in its entirety with that certain <br /> Appendix A: Impact Fee Schedule that is attached hereto and made a part hereof, which attached <br /> Schedule is hereby adopted, approved and made Appendix A to said Chapter 3.18. <br /> Section 5. Appendix B of Chapter 3.18 of the Louisville Municipal Code, entitled <br /> Appendix B: City's Arterial Road System, is hereby repealed and replaced in its entirety with that <br /> certain Appendix B: City's Road System that is attached hereto and made a part hereof, which <br /> attached Schedule is hereby adopted, approved and made Appendix B to said Chapter 3.18. <br /> Section 6. If any portion of this Ordinance is held to be invalid for any reason, such <br /> decisions shall not affect the validity of the remaining portions of this Ordinance. The City <br /> Council hereby declares that it would have passed this Ordinance and each part hereof <br /> irrespective of the fact that any one part be declared invalid. <br /> Section 7. The repeal or modification of any provision of the Municipal Code of the <br /> City of Louisville by this Ordinance shall not release, extinguish, alter, modify, or change in whole <br /> or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br /> under such provision, and each provision shall be treated and held as still remaining in force for the <br /> • purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br /> enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br /> Ordinance No. 1602,Series 2011 <br /> Page 4 of 7 <br />
