<br />Louisville City Council Meeting <br />February 1, 2005 <br />Page 9 of 10 <br /> <br />Appointment of Defense Counsel- Sawyer et al. v. City of Louisville, Case No. <br />OSCVS2, Boulder County District Court <br /> <br />City Attorney Sam Light reported the City was served with a lawsuit regarding the Front <br />Street right-of-way. He recommended Josh Marks with the law firm of Berg Hill <br />Greenleaf & Ruscitti, LLP, be retained to represent the City in the lawsuit. He explained <br />in light of the lack of settlement, this matter may ultimately result in a trial. He noted the <br />firm was retained in the T & T Bennett law suit, and has an expertise in land issues. <br /> <br />MOTION: Council member Marsella moved that Council authorize the City Attorney to <br />execute the agreement to appoint Josh Marks, with the law firm of Berg Hill Greenleaf & <br />Ruscitti. Council member Van Pelt seconded the motion. Roll call was taken. The <br />motion carried by a vote of 5-0. Absent: Council members Brown and Keany. <br /> <br />City Attorney Light updated the Council on the Capitol Publishing litigation. This case <br />involves a public records request for accident reports. He stated the City was successful <br />in serving the principal of the company approximately ten days ago. <br /> <br />CITY MANAGER'S REPORT <br /> <br />City Manager Bill Simmons updated Council on the following scheduled meetings: <br /> <br />. February 2 - Chamber of Commerce Breakfast Meeting - Parking Plan Review <br />. February 15 - Louisville Revitalization Committee meeting <br />. March 9 - Neighborhood Meeting on Street Replacement Projects <br /> <br />Simmons reported the City will receive a revised draft ofBiella/Menkick Agreement <br />from the Town of Superior. He also reported on a request from a local downtown <br />business owner for the City to purchase St. Patrick Day banners for the light poles in <br />downtown Louisville. The estimated cost for the artwork and the banners is $1,900.00. <br /> <br />Assistant City Manager for Governmental Affairs addressed legislation regarding open <br />records requests for accident reports. Chief Goodman has recommended the City pursue <br />new legislation to address this problem. She stated the City could work with other <br />municipalities to present this issue to the state legislators. <br /> <br />City Attorney Sam Light stated his view of the current language is not clear. He stressed <br />the importance of giving clear guidance to the City Clerk with respect to criminal <br />records, and stated direction on the statute would be helpful. <br /> <br />Council supported discussion with other communities to propose new legislation. <br /> <br />COUNCIL COMMENTS AND COMMITTEE REPORTS <br /> <br />Mayor Sisk reported on the BiellalMenkick Agreement and stated the Town of Superior <br /> <br />9 <br />
