Louisville City Council Meeting <br />May 16, 2000 <br />Page 6. <br /> <br />Phare stated that it was his understanding that, as long as the City stayed within the <br />existing boundaries, there would be no issues. The plant is in the City of Louisville and <br />has governmental authority. <br /> <br />Howard asked if the IGA Agreement would limit Louisville's ability to purchase open <br />space. <br /> <br />Davidson stated that it would limit the purchase of open space in the areas that are within <br />the Town of Superior and the City of Boulder. <br /> <br />Mayer asked about the affect of the agreement on Old Town Superior. <br /> <br />Simmons stated that a five-acre parcel has been designated as Rural Preservation Zone. <br /> <br />Mayer asked the City Attorney to comment on Mr. Parker's concerns with regard to <br />annexation and the designation of Rural Preservation. <br /> <br />City Attorney Light stated that if a property is designated rural preservation, under this <br />plan, it could not be annexed to any municipality without amendment to the plan. That <br />would require consent of all the parties. Light added that Rural Preservation areas are <br />retained within Boulder County, and therefore, Boulder County will be the regulatory <br />agency. Light stated that there is some language in Exhibit "A" that under Rural <br />Preservation zoning, the uses can continue. <br /> <br />Mayer stated that it is his understanding that the Rural Preservation classification <br />essentially means that one of the co-signing cities cannot annex the property without the <br />consent of all the parties. <br /> <br />Mayer asked Simmons if the latest language to the Agreement would affect future <br />expansion of the Howard Berry Water Treatment facility and what were the City's <br />options. <br /> <br />Simmons stated that one option would be to negotiate the purchase of the required <br />property from the Town of Superior. <br /> <br />Sam Light, City Attorney stated that the property adjacent to either side of the Howard <br />Berry Water Treatment Plant site, is either County open space or designated Rural <br />Preservation. If these areas were annexed, the City would have to negotiate with the <br />County. <br /> <br />6 <br /> <br /> <br />
