<br />City Council <br />Meeting Minutes <br />April 5, 2005 <br />Page 6 of 12 <br /> <br />Deputy City Manager Julie Boyd reported that the City Staff has been working <br />with the Downtown Business Association to add-day parking for business owners <br />and employees, and to help assure two hour customer parking is available during <br />the day. The DBA has requested the City take a more active role in enforcing the <br />two hour parking limit, including increased patrols, increased fines, and penalties <br />for people who ignore their parking tickets. The ordinance would increase the <br />minimum parking fine assessed by the municipal court from $10.00 to $20.00, <br />with a maximum of $500.00, to be set by the judge. Following the mailing of a <br />notice by the court clerk to a vehicle owner with three unpaid parking tickets, the <br />ordinance would permit the court to enforce payment of the traffic fines with three <br />different methods: 1) Issuance of a Show Cause Order; 2) Vehicle towing and <br />impoundment, and 3) Collection through a civil judgment. <br /> <br />Currently, if tickets are unpaid, the court clerk sends a letter to the owner of the <br />vehicle and the municipal judge must direct any enforcement action. The new <br />ordinance would allow the court clerk to initiate enforcement action, in the case of <br />more than three outstanding tickets, removing this burden from the court and <br />handling it administratively. <br /> <br />City Attorney Sam Light made corrections to the ordinance: Page 2, Subsection <br />C, the phrase "under this title" should be deleted. He noted the first reading of <br />the Ordinance was March 17 and not April 5. He noted a parking violation is a <br />non-criminal offense, and the ordinance pursues other options for compliance. <br /> <br />Mayor Sisk opened the public hearing and requested public comments, and <br />hearing none, closed the public hearing. <br /> <br />MOTION: Council member Brown moved for approval of Ordinance No. 1466, <br />Series 2005, with the following amendments: Page 2, Section C, the phrase <br />"under this title" is deleted, and the first reading of the ordinance be changed to <br />March 17. Council member Keany seconded the motion. Roll call vote was <br />taken.
