All in tavor. <br />Absent - Council member Levihn. <br /> <br />ORDINANCE No. 1467, SERIES 2005 - AN ORDINANCE APPROVING THE <br />VACATION OF THE CITY'S INTEREST IN CERTAIN RIGHT-OF-WAY <br />ADJACENT TO 101 WEST SPRUCE STREET IN THE CITY OF LOUISVILLE - <br />2nd reading - public hearing continued from 4/5/05 (advertised Daily Camera <br />3/29/05) <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1467, Series 2005. <br /> <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br /> <br />Planning Director Paul Wood explained the ordinance vacates the City's interest <br />in the right-ot-way adjacent to 101 West Spruce Street. The property owners at <br />101 W. Spruce Street initiated this request tor a right-ot-way vacation in 2004 <br />based on a survey, which indicated a 30-toot strip ot property adjacent to the <br />south side ot their parcel might no longer be needed as public street right-ot-way. <br />The 30-toot by 198-toot strip has been reserved tor road purposes since 1909, <br />when the property was located in unincorporated Boulder County. The property <br />was annexed to the City in 1964, as the Enrietto Annexation, but was never <br />subdivided. The current owner Mr. Rick Lucky is the applicant tor the right-ot- <br />way vacation. The survey depicts the location ot the right-ot-way to be <br />immediately north ot the existing 60-toot wide Spruce Street right-ot-way and <br />appears to have been reserved tor one ot two reasons: <br />
