<br />City Council <br />Meeting Minutes <br />May 3, 2005 <br />Page 4 of 16 <br /> <br />Council member Keany asked City Attorney Light if the expiration of the <br />ordinance could be set at ninety days and/or the finalization of the Comp Plan by <br />the City Council. He asked if the moratorium could be repealed before it sunsets. <br />City Attorney Light explained that Council can repeal the ordinance. <br /> <br />Council member Keany asked if a sooner expiration of the ordinance might <br />cause Council to act more expediently. City Attorney Light clarified that Council <br />can set the moratorium deadline in the ordinance for a date certain, and it can <br />expire earlier if need be. <br /> <br />Council member Marsella did not favor an extension beyond sixty days. <br /> <br />Mayor Sisk asked City Attorney Light to clarify the process. City Attorney Light <br />explained the moratorium has the effect of suspending what the ordinance would <br />otherwise require, such as taking an application through the process to a hearing <br />and approval. <br /> <br />Mayor Sisk suggested the expiration of the ordinance be the 1st meeting in <br />August, August 2, 2005. <br /> <br />Council member Keany asked if the Comp Plan becomes effective on the day of <br />approval. City Attorney Light confirmed it would. <br /> <br />MOTION: Council member Keany moved that Council send out Ordinance <br />NO.1469, Series 2005 for publication and set a public hearing for May 17, 2005. <br />Council member Levihn seconded the motion. All in favor. Absent - Council <br />member Brown. <br /> <br />ORDINANCE No. 1464, SERIES 2005 - AN ORDINANCE OF THE CITY OF <br />LOUISVILLE, BOULDER COUNTY, COLORADO, GRANTING A NON- <br />EXCLUSIVE FRANCHISE TO PUBLIC SERVICE COMPANY OF COLORADO, <br />ITS AFFILIATES, SUCCESSORS AND ASSIGNS, OF THE RIGHT TO USE <br />THE STREETS WITHIN THE CITY TO FURNISH, SELL, TRANSMIT, <br />TRANSPORT AND DISTRIBUTE GAS AND ELECTRICITY TO THE CITY AND <br />TO ALL RESIDENTS OF THE CITY, GRANTING THE RIGHT TO ACQUIRE, <br />CONSTRUCT, INSTALL, LOCATE, MAINTAIN, OPERATE AND EXTEND <br />INTO, WITHIN AND THROUGH THE CITY ALL FACILITIES REASONABLY <br />NECESSARY TO FURNISH, SELL, TRANSMIT, TRANSPORT AND <br />DISTRIBUTE GAS AND ELECTRICITY WITHIN AND THROUGH THE CITY, <br />AND GRANTING THE RIGHT TO PROVIDE STREET LIGHTING SERVICE TO <br />THE CITY; AND FIXING THE TERMS AND CONDITIONS THEREOF - 2nd <br />reading - public hearing <br /> <br />Mayor Sisk requested a City Attorney introduction. <br />
