He <br />stated the PUC is currently evaluating those issues. <br /> <br />Dudley Spiller, 1775 Sherman Street, Denver, CO, Attorney representing Xcel <br />energy, explained he has been involved in drafting franchise agreements for <br />Public Service Company as well as negotiating franchises. He stressed the <br />Public Utility Commission has exclusive jurisdiction over the areas of rates, <br />service, and facilities of public utilities. He explained all Xcel franchise <br />agreements are based on the same model, which are uniform and simple, and in <br />compliance with state statutes, which stipulates no preferences or discrimination. <br /> <br />Mr. Spiller addressed the issue of renewable resources, and explained the PUC <br />has heavily regulated the Public Service Company. He explained his involvement <br />in a lease/cost planning process, where Public Service appeared before the <br />PUC, and through the process Public Service came up with different types of <br />generation resources, all of which are bound by the PUC. <br />Mayor Sisk requested public comment. <br /> <br />Paul Everitt, 301 Van Buren Court, Louisville, CO addressed Louisville's frequent <br />power fluxes and outages, which required him to purchase a backup power <br />system for his computer. He noted it is a significant financial issue for local <br />businesses. He asked that the City consider hiring a consultant to assist in the <br />franchise negotiations. He did not favor the 20-year franchise term. <br /> <br />Mona Newton, 708 Grant Avenue, Louisville, CO favored a shorter term <br />franchise and supported rebates for energy efficient products. She addressed <br />Louisville's frequent power outages and encouraged Council to renegotiate. <br /> <br />Mr. Rick Gilliam, 590 Redstone Drive, Broomfield, CO addressed the Xcel model <br />franchise agreement, which limits the ability to negotiate. He reviewed the state <br />statutes regarding public utilities and urged Council to delay the vote and <br />renegotiate the Xcel franchise agreement. <br /> <br />Angie Layton Anderson, 619 W. Juniper Court, Louisville, CO voiced her support <br />of renewable energy. She stated the City of Louisville is capable of negotiating a <br />fair franchise agreement. <br /> <br />Kurt Aronow, 545 Ford Court, Louisville, CO stated Xcel Energy is building a coal <br />plant in Pueblo. He explained coal plants are the single largest cause of global <br />warming and air pollution. He stated there are alternatives such as wind energy <br />and noted advances have been made in energy storage. He opposed a 20-year <br />agreement and urged Council to renegotiate for a five-year agreement. <br /> <br />Doug Grinbergs, 530 W. Sycamore Circle, Louisville, CO stressed a 20-year <br />franchise agreement is too long. He noted the new comp plan may provide for <br />
