<br />City Council <br />Meeting Minutes <br />May 3, 2005 <br />Page 7 of 16 <br /> <br />more people and the need for more energy. He stated the second reading of the <br />ordinance is premature. He offered suggestions such as conducting additional <br />study sessions, forming a citizen's committee, and hiring a consultant. <br /> <br />Alison Burchell, 1270 Chambers Drive, Boulder, CO representing the Boulder <br />Renewable Energy & Energy Efficiency (BREEE) organization, offered their <br />assistance in negotiating a franchise agreement. She offered amendments to <br />the agreement, which were compliant to Amendment 37 and provisions for <br />modification. She presented a draft agreement as an example. <br /> <br />Robin Resin, 559 West Street, Louisville, CO stated she wished to add her voice <br />along with other residents opposing a 20-year franchise agreement. <br /> <br />COUNCIL COMMENTS <br /> <br />Council member Van Pelt asked a Public Service Company representative to <br />address the 20-year franchise agreement, and their unwillingness to add <br />language regarding renewable energy. Mr. West stated that a 20-year franchise <br />agreement is the standard throughout the state, and stressed the PUC oversees <br />all utilities. <br /> <br />Council member Van Pelt asked Mr. West to address other community's <br />negotiations for 15-year franchise agreements. Mr. West noted that some home <br />rule communities, such as the City of Loveland, have charters which stipulate the <br />term limit for franchise agreements. <br /> <br />Council member Keany asked why the franchise agreement cannot contain <br />language where power and street light outages are addressed. Mr. West stated <br />the City has not made that request. He did not believe it was a matter to be <br />addressed in the franchise agreement. He stated if the City was unhappy with <br />the service provided by Public Service, their recourse would be through the <br />Public Utilities Commission. <br /> <br />Council member Keany asked if the public works crew report street light outages <br />on a monthly basis, and for Public Service's response time. Public Works <br />Director Tom Phare stated in addition to public works crews, citizens report street <br />light outages. He commented Public Service's response time is sporadic. <br /> <br />Council member Marsella stated the 20-year term is not acceptable. She asked <br />why the implementation of Amendment 37 could not be incorporated into the <br />agreement. <br /> <br />Mr. Spiller stated all the citizen's concern voiced this evening is governed by the <br />Public Utilities Commission. He explained if there is a particular report required <br />by the City, Public Service will be happy to supply that report. <br />
