Mr. Spiller responded no, and stated he did not <br />understand the request for a five-year agreement, and explained the streets and <br />the usage of the streets would not change. <br /> <br />Council member Van Pelt stated Public Service presented a franchise agreement <br />and prohibited negotiations. She asked how a master franchise agreement, <br />governed by the Public Utilities Commission, could change so much. Mr. Stiller <br />noted there is an attempt to negotiate with municipalities and changes are made <br />for the betterment of all municipalities. He stressed it is a complicated issue, with <br />respect to Public Utilities Commission regulations and cost. <br /> <br />Mayor Sisk asked if all the consumers pay for the undergrounding. Mr. Stiller <br />responded yes. <br /> <br />Mayor Sisk asked if the City of Denver is negotiating a franchise agreement that <br />includes renewable energy. Mr. Spiller stated the City of Denver and Public <br />Service have agreed not to discuss the franchise negotiations with other <br />communities. He noted he was not involved in the discussions, but stated it is <br />crucial that Public Service be consistent in the franchise agreement negotiations. <br /> <br />Mayor Sisk explained that Carbondale and Loveland's charters require no more <br />than 15-year franchise agreement. He asked Mr. West, since the passing of <br />Amendment 37, has there been any franchise agreement that include renewable <br />energy. Mr. West stated he was not aware of any. <br /> <br />Mayor Sisk asked if performance standards do not belong in a franchise <br />agreement, wouldn't it be appropriate for the City to file complaints with the <br />Public Utilities Commission. Mr. West stated it would be appropriate, however <br />he'd rather Public Service Company be responsible for repairing services, and <br />asked the City and citizens to contact him or Mr. Anderson with those problems. <br /> <br />Mayor Sisk requested one re-open clause within a 20-year franchise agreement, <br />to address Amendment 37. <br /> <br />Mayor Sisk requested additional public comments. <br /> <br />Paul Everett, 301 Van Buren Court, Louisville, CO requested Public Service's <br />PUD compliance report be forwarded to the City and posted on the Web Page. <br /> <br />Mr. Rick Gilliam, 590 Redstone Drive, Broomfield, CO stated Public Service <br />Company should negotiate franchise agreements every five years. <br /> <br />Alison Burchell, 1270 Chambers Drive, Boulder, CO reviewed other states <br />renewable energy programs and benefits. <br />
