<br />City Council <br />Meeting Minutes <br />July 19, 2005 <br />Page 3 of 9 <br /> <br />LOUSIVLLE SOUTH 96TH STREET ANNEXATION NO.3, AND SETTING A <br />PUBLIC HEARING THEREON - SET PUBLIC HEARING FOR 9/6/05 <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood explained the City initiated this annexation by <br />petition to annex a 1.4-acre parcel in conjunction with a road construction project <br />at the southeast corner of S. 96th Street and Dillon Road. Land was acquired <br />from the Schreiter property for road right-of-way purposes in 2003. Resolution <br />No. 27, Series 2005 supersedes Resolution No. 26 and is intended to establish a <br />hearing date within the timeframe required by state statute. Resolution No. 26, <br />2005 was approved by Council on July 5, 2005, and is being repealed as it <br />established a timeframe for the public hearing, which exceeds the maximum 60- <br />day timeframe between the effective date of the resolution of substantial <br />compliance and the public hearing. <br /> <br />Mayor Sisk requested public comment. There were no comments. <br /> <br />Mayor Sisk asked for City Attorney recommendation. City Attorney Light advised <br />Council that only one motion was required. <br /> <br />MOTION: Council member Van Pelt moved to repeal Resolution No. 26, 2005, <br />and approve Resolution No. 27, 2005, and set a public hearing for September 6, <br />2005, seconded by Council member Levihn. All in favor. Absent: Council <br />members Keany, Marsella and Brown. <br /> <br />ORDINANCE No. 1456, SERIES 2004 - AN ORDINANCE ZONING <br />PROPERTY KNOWN AS THE HOYLE PROPERTY - 2nd reading - public <br />hearing (advertised Daily Camera 9/25/04 & 2/27/05) - continued frorn <br />10/19/04,2/1/05,3/17/05, & 5/17/05 - Applicant requests a continuance <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1456, Series 2004. <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Planning Director Paul Wood reported on correspondence received from Mr. <br />Richard Lopez, representing the Hoyle family, requesting a delay in the hearing <br />until such time as the City has acted on the pending Comprehensive Plan <br />Update. <br /> <br />MOTION: Mayor Sisk moved to continue the public hearing to October 4, 2005, <br />seconded by Council member Clabots. All in favor. Absent: Council members <br />Keany, Marsella and Brown. <br />
