Louisville City Council Meeting <br />June 20, 2000 <br />Page 12. <br /> <br />Johnstone stated that the Planning Commission recommendation stipulated that two <br />conditions be attached requiring: 1) the conveyance of a shared access easement, and 2) <br />that authorization of the Special Review Use and Final PUD Development Plan be <br />contingent upon the authorization of a revocable license agreement for the applicant. <br /> <br />Johnstone stated that the applicant is requesting an exception to the requirement of <br />providing a 10' landscape and parking setback adjacent to the rear, or east property line. <br />The Planning Commission supported the exception based upon: 1) the PUD exceeding <br />the minimum requirements for open space and shrub counts, and 2) the unlikely event <br />that the alley would be constructed, and even if constructed, the railroad berm would <br />visually screen the parking lot from properties to the east. Staff has recommended some <br />additional locations for signage based on the architecture of the building, and the lighting <br />has been modified to comply with the Planning Commission recommendations. <br /> <br />Davidson called for Applicant introduction. <br /> <br />Wendy Fickbohm, 1314 Main Street stated that she is the applicant and has been with <br />State Farm Insurance for eighteen years, sixteen of those years have been in the <br />Louisville/Lafayette area. She declared that her primary objective is to develop a <br />building that reflects the character of downtown Louisville. She stated that this project <br />has a strong architectural presence, while maintaining a historical interest and reflecting <br />the commercial guidelines of downtown Louisville. She noted that the building is 5,000 <br />square feet and she intends to utilize 1500 square feet on the main level and rent the <br />remainder of the building to small one and two person offices. Currently the existing <br />building is slightly over 800 square feet and with four staff persons and her, they are <br />quite crowed. <br /> <br />Fickbohm noted that this PUD has been in theplanning stages for two years. She stated <br />that in order to develop a project of this size and scope, they need access to the Lafayette <br />right-of-way and as an abutting property owner, they have a legal right to ingress/egress <br />this property from the Lafayette right-of-way as did the Fire District. She noted that the <br />City has a revocable license agreement with the Fire District, but that the agreement did <br />not convey ownership and that agreement could be granted to more than one party. She <br />stated that she had met with the Fire Marshall and he did not indicate any conflict with <br />the shared usage of the 24' wide driveway. The Fire District Board agreed but later <br />withdrew its support citing safety issues. She has agreed to widen the existing street by <br />12' to make the driveway 36'. She contracted for a traffic analysis engineering report <br />from Transplan Associates, which indicated that there would not be any conflict with <br />turning movements. She stated that the Planning Department and the Planning <br />Commission have approved this project with strong praise for its design and presence. <br /> <br />12 <br /> <br /> <br />
