Motion carried. <br />Howard abstained. <br /> <br />RESOLUTION NO. 35, SERIES 2000 - A RESOLUTION APPROVING AN <br />AMENDED FINAL PUD DEVELOPMENT PLAN AND SPECIAL REVIEW USE <br />FOR A NEW OFFICE BUILDING, 1314 MAIN STREET <br /> <br />Davidson called for Staff introduction. <br /> <br />Ken Johnstone, Principal Planner stated that the applicant and property owner, Wendy J. <br />Fickbohm, is requesting a Special Review Use and a Final PUD Development Plan to <br />construct a new, 5,000 SF, two story, professional office building. The property is located <br />within the CN Zone District, which provides for a mix of residential and commercial <br />uses. The CN District requires strict review of all uses through a Special Review Use. <br /> <br />Johnstone noted that the lot is 17,613 SF, and is occupied by an 860 SF, one story, frame <br />construction, professional office building. To the north isthe Martial Arts Studio zoned <br />CN, and to the east a platted undeveloped alley and the Burlington Northern & Santa Fe <br />Railroad right-of-way. To the south is the Louisville Fire Protection District (LFPD) Fire <br />Station 4/1, which was granted a revocable license agreement in 1993 to construct a 24' <br />wide concrete driveway. The applicant is seeking Council authorization, through a <br />revocable license agreement to jointly use the drive improvements within the public <br />right-of-way as the primary means of ingress/egress to the proposed rear parking area. <br /> <br />Johnstone stated that the proposed redevelopment is subject to the Commercial <br />Development Design Guidelines and Standards (CDDG) and the PUD reflects general <br />compliance with respect to parking, architecture, and landscaping. Johnstone noted that <br />the main issue relative to the PUD request is the opposition expressed by the LFPD with <br />regard to the proposed joint use of the driveway constructed by the District within the <br />adjoining right-of-way. The Fire District's concerns are based upon current operations <br />relative to the potential impact of joint use on safe vehicle and pedestrian movements. <br />Johnstone noted that in response to the Fire District's concerns, the applicant has <br />contracted Transplan Associates for the preparation of a traffic impact study to evaluate if <br />the proposal for joint use does pose safety issues with the operations of the Fire District. <br />Johnstone stated that the applicant has attempted to negotiate with the Martial Art Studio <br />to the north for joint access, but has not been successful. <br /> <br />11 <br /> <br /> <br />
