He noted the staff <br /> presentation would include both ordinances. <br /> Mayor Muckle opened the public hearing and requested the staff presentation. <br /> Planning Director Russ explained Ordinances No. 1607 and No. 1608, Series 2011, if <br /> authorized, approve the partial vacation of the Main Street ROW adjacent to Lots 14 <br /> and 15, Block 8, and Lots 5 and 6, Block 7, Murphy Place Subdivision, in the City of <br /> Louisville. It also allows the City to enter into separate agreements with the home <br /> owners of 224 Roosevelt Avenue and 224 Main Street concerning a right-of-way (ROW) <br /> vacation for the south end of Main Street, adjacent to Community Park. <br /> Staff and both home owners propose a City ROW vacation of approximately four <br /> hundred fifty (450) square feet (9'x 50') to 224 Main Street and a ROW vacation of five <br /> hundred fifty (550) square feet (11' x 50') to 224 Roosevelt. The vacations would extend <br /> from the existing property lines to a line equal to the back of the public sidewalk north of <br /> their property. In this agreement, the City, at the Owner's expense, agrees to construct <br /> a basic landscape for the remaining 40 feet of public ROW, including: <br /> 1. Remove existing gravel. <br /> 2. Install Kentucky bluegrass sod with an appropriate extension of the City's <br /> Community Park irrigation system. <br /> ID <br /> 3. Relocate the existing park split-rail fence to the new end of Main Street. <br /> The City retains the right to install other improvements on the remaining 40 feet of ROW <br /> subject to the following: <br /> 1. The City landscape standard will maintain sight lines of no less than fifty percent <br /> (50%) of the adjoining property. <br /> 2. Lighting will be limited to downcast pedestrian scale light fixtures. <br /> 3. The City shall prohibit parking of private vehicles on the remaining 40 feet of <br /> ROW. <br /> 4. The City design and programming for the remaining 40 feet of ROW will only <br /> accommodate passive recreational activities. <br /> The property owners agree to install improvements on the vacated ROW subject to the <br /> following: <br /> 1. The area of the vacated ROW qualifies toward private property's zoning and <br /> development calculations of applicable lot coverage, floor area or similar yard <br /> and bulk requirements. <br /> 2. Landscape the vacated ROW to a minimum standard with a combination of <br /> Kentucky bluegrass sod, low level shrubs, and trees which at maturity maintain <br /> sight lines of no less than fifty percent (50%) of the City's Remaining 40 feet of <br /> ROW. <br /> ID <br />
