Absent: Councilor Dalton. <br /> ORDINANCE No. 1605, SERIES 2011 —AN ORDINANCE AMENDING <br /> SECTION 17.12.050 OF THE LOUISVILLE MUNICIPAL CODE TO ALLOW <br /> ADDITIONS TO CONTINUE EXISTING ROOF PITCHES ON LEGAL NON- <br /> CONFORMING STRUCTURES IN THE OLD TOWN OVERLAY DISTRICT AND <br /> ADDING SECTION 17.08.413 TO THE LOUISVILLE MUNICIPAL CODE TO <br /> DEFINE ROOF PITCH — 2nd Reading Public Hearing <br /> Mayor Muckle requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No.1605, Series 2011. <br /> Mayor Muckle opened the public hearing and requested a staff presentation. <br /> • Planning Director Russ explained the City Council continued the Public Hearing on this <br /> Ordinance to December 20, 2011. Staff requested the continuance so that the project <br /> manager, Planning Intern Scott Robinson, could make the presentation. <br /> Planning Intern Robinson explained the Old Town Overlay Zoning District Regulations <br /> set specific standards for residential development in Old Town Louisville. Louisville <br /> Municipal Code (LMC) Sec. 17.12.050 C includes requirements for the design and slope <br /> of roofs in old town. This section of code has been interpreted to mean 80% of all roofs <br /> on both principal and accessory structures in Old Town must have a pitch of 6:12 or <br /> greater. The Planning Staff and members of the public and the design community have <br /> found this section of the LMC to be confusing and overly restrictive in cases where <br /> additions are proposed to existing structures that have a roof pitch less than 6:12 <br /> There are 193 homes, or 34% of all homes, in Old Town Louisville which do not meet <br /> the roof pitch requirement. They are spread throughout the Old Town Overlay District. <br /> These structures are determined to be "legal nonconforming" because they do not meet <br /> the requirements of the Old Town Overlay District, but they are legal because they were <br /> constructed prior to the adoption of the regulations. When legal nonconforming <br /> structures are modified, they are required to either comply with the requirements of the <br /> Old Town Overlay District or receive a variance from the Board of Adjustment. This <br /> means any addition to a nonconforming structure (roof pitch less than <br /> 6:12) would be required to have a roof with a pitch of 6:12 or greater. <br /> • Planning Staff suggested exempting additions to nonconforming roof structures from the <br /> requirements of Section 17.12.050 C. The intent would be to permit additions to flat or <br />
