City Council <br /> Meeting Minutes <br /> January 3, 2011 <br /> Page 5 of 14 <br /> vision clearance area and the public ROW to a set distance from the intersection (15' for <br /> alleys-30' for streets). Staff concluded the distances identified in the LMC exceed what <br /> is necessary for adequate safety. <br /> The change to vision clearance areas at alley intersections in the Central Business <br /> District and the addition of vision clearance areas at trail intersections will improve <br /> safety for pedestrians and cyclists without any immediate negative effects on property <br /> owners. A vision clearance area at alley intersections restricting buildings, landscaping, <br /> and fences would improve pedestrian visibility to cars exiting alleys. Staff recommended <br /> making the following changes to the vision clearance requirements in the LMC: <br /> 1. Change the boundary used to measure vision clearance from the property line to <br /> the roadway. <br /> 2. Introduce alleyway vision clearance areas in old town. <br /> 3. Introduce vision clearance areas at the intersection of multi-use paths and <br /> streets. <br /> COUNCIL COMMENT <br /> Councilor Keany inquired whether the new library building complies with the vision <br /> clearance of the alley. It was confirmed it does comply. Councilor Keany asked if there <br /> are downtown buildings, which do not comply. Planning Director Russ explained the <br /> only potential for non-compliance are the buildings, which front the side streets, but it <br /> would only be on the caps of the sidewalks. <br /> Councilor Keany asked if the garage behind the old mortuary building is in compliance. <br /> He voiced concern the ordinance would conflict with the preservation of historic <br /> structures and asked if there is a balance. Planning Director Russ stated life safety <br /> issues would take precedence and the City would create the safest environment for <br /> pedestrians and cyclists. <br /> Mayor Muckle requested public comment and hearing none closed the public hearing. <br /> MOTION: Councilor Loo moved to approve Ordinance No. 1609, Series 2011, <br /> seconded by Councilor Dalton. Roll call vote was taken. The motion carried by a vote of <br /> 6-0. <br /> ORDINANCE No. 1611, SERIES 2011 —AN ORDINANCE AMENDING CHAPTER <br /> 17.52 OF THE LOUISVILLE OF THE LOUISVILLE MUNICIPAL CODE TO ADOPT <br /> PROVISIONS REGARDING REQUESTS FOR REASONABLE ACCOMMODATIONS <br /> UNDER THE FEDERAL FAIR HOUSING ACT—2nd Reading —Public Hearing <br /> Mayor Muckle requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No. 1611, Series 2011. <br />
