Louisville City Council Meeting
July 5, 2000
Page 10

Tom McAvinew, 229 Lois Drive, Vice-Chairman of the Planning Commission, stated
that his purpose was to give some insight on the Planning Commission decisions. The
Planning Commission at its' June 13, 2000, meeting denied the application by a vote of
6-0. He stated that he believed the decision was based on a use issue. He stated that
there was no traffic study available at the time of the Planning Commission's public
hearing. He stated that he did not believe the traffic study would have altered their
decision. He noted that one of the compelling testimonies given was from a property
owner who voiced concern that the value of his property would be greatly reduced if a
school was allowed. McAvinew noted the problem of mixed vehicle use. The Planning
Commission decided there was not the same level of safety as available in a traditional
school setting. He stated that the Planning Commission would not compromise the SOB
Ordinance, requiring the City to amend and relocate the sexually oriented businesses.
McAvinew reviewed the criteria of the SRU, and summarized that based on Items 1-2-4,
the SRU criteria have not been met. He urged Council to uphold the Planning
Commission's decision, that the site is not appropriate for a school.

Edward Cook, 4048 N 57th Street, Boulder, CO, stated that he is the owner of National
Specialty Lighting, located at 1753 Boxelder. He voiced his concern with traffic safety
and the disregard for the industrial zoning. He noted his main concern is traffic
congestion and its impact on his business. He stated he has 2 semi-tractor trailers and 10
pickup and delivery trucks on the street each day and that the traffic is wrong for a school
facility. He noted that if he applied to put his warehouse next to a school, zoning would
prohibit such use. He stressed that the planning and zoning regulations should be
observed.

Dale Lawrence, 2319 Dogwood Circle, Louisville, CO, stated that Boulder Valley School
District has approved the charter for the Peak to Peak School on this site. He felt the site
is not only workable, but that it would strengthen the community. He urged Council to
approve the application.

Beth Hickernell, 575 Orchard Drive, Louisville, CO, stated that she has two sons who are
excited to attend Peak to Peak School. She, and many volunteers, worked well over 100
hours to help Peak to Peak Charter School to be ready in the fall. She asked Council to
give Peak to Peak the opportunity to join the other fine schools in Louisville.

Frank Harrison, 1105 W. Enclave Circle, Louisville, CO, stated that he has two children
enrolled in the Peak to Peak Charter School, and asked Council to support the project.
He stated that it was good for the future of the community and the positives by far
outweigh the negatives.

10
