Louisville City Council Meeting <br />July 5, 2000 <br />Page 17 <br /> <br />Laurin Quiat, attorney representing the McBride Brother, LLC, PlastiFab, and Intrex <br />Corp., quoted the 1979 Declaration by MDC, which states as follows: Section 2.2 <br />Permitted Uses: "Building sites shall be utilized only for engineering, research facilities, <br />laboratories, light industrial uses, offices distribution, and warehousing and such other <br />uses as the Declarant shall permit in sole construction." Mr. Quiat stated that it would <br />take a 2/3 or 67% vote of the property owners to override the covenants. <br /> <br />Keany asked Quiat if the school received approval, would a lawsuit be forthcoming. <br />Quiat stated he would file a lawsuit. <br /> <br />Keany asked Light to clarify the definition of schools by SRU in a Tech Center. Light <br />stated that a school use is a Special Review Use, however the definition of a school is <br />very broad and includes public and private educational facilities. Light stated that CTC <br />was annexed and zoned in 1979 after zoning was in place, so no Industrial zone was <br />listed and schools were a Special Review Use. <br /> <br />Brown asked Kelley about the timing of Phase II for Peak to Peak School. Kelly stated <br />they have a three year lease but are looking for other land for the Peak to Peak K-12 <br />Campus. She stated that the current site has an enrollment cap of 350 students. <br /> <br />Brown asked about the projection of 550 students and whether that was a temporary use. <br />Kelley that the 550 students number includes the Phase II second floor expansion. <br /> <br />Brown asked the applicant to describe Peak to Peak's long term goals. Drummond stated <br />they have contacted various individuals in Boulder County about purchasing property for <br />a campus that would include a middle school and high school. Drummond stated one <br />option might be to leave K-5 at the CTC site and relocate later to join the middle and high <br />school at another site. <br /> <br />Brown asked Planning Director Wood about potential hazards and what types of <br />hazardous material are at CTC. Wood stated that he did not have an inventory of <br />hazardous materials on the CTC properties. <br /> <br />Davidson asked Light about the Sexually Oriented Business Ordinance and the St. Louis <br />Church proposal to build a school near the area. Light stated that the minimum limit is <br />1,500 feet from a school. <br /> <br />Davidson asked Public Works Director Phare about extending Boxelder Street to 104th <br />Street, and how that would impact the traffic patterns. Phare stated it would be an equal <br />distribution. If the land were platted, there would be improvements to 104th which would <br /> <br />17 <br /> <br /> <br />
