<br />ORDINANCE NO. 1236 <br />SERIES 1996 <br /> <br />AN ORDINANCE PROVIDING FOR THE DECRIMINALIZATION OF <br />CERTAIN TRAFFIC OFFENSES AND OTHER MISCELLANEOUS CODE <br />VIOLATIONS. <br /> <br />WHEREAS, state law authorizes municipalities to treat certain <br />traffic violations as traffic infractions which constitute a civil <br />matter; and <br /> <br />WHEREAS, such treatment would help alleviate congestion of the <br />Municipal Court docket, streamline proceedings in the Municipal <br />Court, reduce burdens on persons required to appear in the <br />Municipal Court, and otherwise reduce burdens on the City and its <br />citizens; and <br /> <br />WHEREAS, the City Council wishes to decriminalize certain <br />traffic offenses contained in the Louisville Municipal Code and the <br />Model Traffic Code as adopted and amended therein, consistent with <br />state law, and to provide for the civil classification of certain <br />other non-traffic violations which are neither criminal nor <br />punishable by imprisonment under counterpart state law. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Chapter 6.04 of the Louisville Municipal Code <br />is amended by the addition of a new Section 6.04.030 to read as <br />follows: <br /> <br />6.04.030 Penalty. <br /> <br />Violation of any provision of this Chapter is civil <br />for which imprisonment is not a possible penalty and for <br />which the sole penalty provided shall be a fine. Any <br />person who shall violate any provision of this Chapter <br />against whom judgment is entered shall be subject to a <br />fine of not more than five hundred dollars ($500.00) and <br /> <br />1 <br />
