<br />shall not be subject to imprisonment on account of such <br />judgment. For any violation of any provision of this <br />Chapter, the Court may enter a judgment of liability by <br />default against the defendant for failure to appear or to <br />pay, and may assess such penalty, together with such <br />court costs and surcharges, as are established by law. <br /> <br />Section 2. Chapter 8.08 of the Louisville Municipal Code <br />is amended by the addition of a new Section 8.08.050 to read as <br />follows: <br /> <br />8.08.050 Penalty. <br /> <br />Violation of any provision of this Chapter is civil <br />for which imprisonment is not a possible penalty and for <br />which the sole penalty provided shall be a fine. Any <br />person who shall violate any of the provisions of this <br />Chapter against whom judgment is entered shall be subject <br />to a fine of not more than five hundred dollars ($500.00) <br />and shall not be subject to imprisonment on account of <br />such judgment. For any violation of any provision of <br />this Chapter, the Court may enter a judgment of liability <br />by default against the defendant for failure to appear or <br />to pay, and may assess such penalty, together with such <br />court costs and surcharges, as are established by law. <br /> <br />Section 3. <br />Code is amended <br />stricken through; <br /> <br />Section 9.04.040 of the Louisville Municipal <br />to read as follows (words to be deleted are <br />words to be added are capitalized) : <br /> <br />9.04.040 Failure to Appear. <br /> <br />In the event any person fails to comply, or fails to <br />respond, to a summons directing an appearance in <br />municipal court, the clerk of the municipal court shall <br />forthwith file a complaint against such person and shall <br />issue and have served a warrant for ffi.s. THE PERSON'S <br />arrest. THIS SECTION DOES NOT APPLY TO ANY PERSON WHO IS <br />CHARGED WITH A CIVIL TRAFFIC INFRACTION WHERE ENTRY OF A <br />DEFAULT JUDGMENT IS AUTHORIZED BY ANY PROVISION OF THIS <br />CODE, OR WHO IS CHARGED WITH ANY AND OTHER ORDINANCE <br />VIOLATION DEEMED CIVIL BY ANY PROVISION OF THIS CODE AND <br />FOR WHICH IMPRISONMENT IS NOT A POSSIBLE PENALTY. <br /> <br />2 <br />
