Louisville City Council Meeting
August 15, 2000
Page 16.

Howard stated that he did not feel it was reasonable for Council to place a moratorium on
all CTC activities for the 12 lots affected. He felt that the fastest way to resolve this
matter was with the CTC District. Howard suggested that Staff attend CTC District
meetings to address the safety issues.

Pennock asked Council for approval of the project subject to conditions that would be
reviewed at the time of the Certificate of Occupancy. He stated that the CTC District
may be very slow to resolve this matter and the McBride's would be further delayed.

Davidson asked that other properties be given notice of the resurfacing of the emergency
easement. He noted that participation in the construction is not the issue, maintenance is.
He stated that he has no problem with placing a condition on the PUD as suggested by
Mr. Pennock.

Pennock stated that with regard to the property line issue, he has worked with other
communities, in similar situations, and has been successful in subdividing properties.

With regard to the property line matter, Mayer stated that the City has to follow its own
ordinances.

Tom McBride, 1815 Boxelder Street, Louisville, CO, stated that the other item addressed
at the last meeting was the access of the 30 foot easement on the property. He stated that
they would like to have it changed from public access to emergency access.

Wood stated that the resolution identified three conditions, 1) the CTC convenants, 2) a
60-foot easement be modified to a 30-foot easement, and 3) a employee break area.

MOTION: Davidson moved that Council continue Resolution No. 45, Series 2000, until
the September 5, 2000 Council meeting, seconded by Howard. Roll call vote was taken.
The motion passed by a vote of 4-2. Keany and Levihn voted no.

RESOLUTION NO. 48, SERIES 2000 - FINAL PUD DEVELOPMENT PLAN
AND AMENDED FINAL PUD DEVELOPMENT PLAN, 817 FRONT STREET,
834 FRONT STREET (parking only) AND 901/909 FRONT STREET (amended
PUD)

Davidson called for Staff presentation.

16
