Louisville City Council Meeting
September 5, 2000
Page 21.

Davidson commented that some people agreed with the zoning. He disagreed with the
comment that the Enclave project is not suitable for a park and stated it would have been
an excellent area for a park.

Howard asked about the proposed developments' single entrance/exit. Spam stated that
there were multiple barriers on the south end of the property that are dedicated public
right-of-ways (bike paths) that prohibit a secondary entrance. A secondary entrance/exit
would entail having traffic cross the bicycle and pedestrian paths. Another option would
have been off Via Appia, however there is another dedicated public right-of-way with
approximately 12 mature trees that separate the properties. Howard stated that he likes to
see traffic flow through the neighborhoods. Howard asked for the square footage of the
homestead. Jobelle Fischer stated the homestead is approximately 3,200 square feet.

Levihn stated that some of the neighbors complained about debris on the lots. He asked
if the lots would be cleared of all debris. Scarbaugh stated that there is not any debris on
the property.

Scarbaugh addressed the single entrance/exist issue. He stated that the Fischer property
does not touch the Via Appia right-of-way and is separated from the Spruce Lane
subdivision by a barricade. To the south is a dedicated bike path and open space. He
stated that to modify the plat would require the signature of every owner along that right-
of-way.

Mayer commented that less density would be more desirable.

MOTION: Sisk moved that Council approve Resolution No. 51, Series 2000, seconded
by Levihn.

Light offered a friendly amendment that on Section 1, Items 1, 3, 4, 6 and 7 be deleted.
On Section 2, page 3, the first sentence be struck and the second sentence be revised,
after the comma, to read "may approve or disapprove one or more ordinances annexing
the subject property to the City of Louisville."

Sisk and Levihn accepted the friendly amendment.
Roll call vote was taken. The motion passed by avote of 5-2. Davidson and Mayer voted
no.

ORDINANCE NO. 1444, SERIES 2000 - AN ORDINANCE APPROVING AN
ANNEXATION, KNOWN AS THE FISCHER ANNEXATION, TO THE CITY OF
LOUISVILLE, COLORADO - 1st reading - public hearing

21
