Ranu further stated that the legislative intent <br />of Ordinance No. 1287, Series 1998, has always been clear, however members of the <br />development community have had some difficulty interpreting the language. He <br />suggested striking the final sentence in Version C, paragraph A, "Further for purposes of <br />this section only, floor area below ground level is considered part of a structure." <br /> <br />Referring to the Hartronft letter, Keany asked for a definition of structure. Hartronft <br />stated that the problem lies in the definition of structure and floor space. He noted that the <br />intent of adding habitable floor area to an existing structure would require the parking <br />fee. Hartronft stated that the language of the ordinance uses both words interchangeably <br />and suggested using one or the other. <br /> <br />There was discussion relative to habitable floor space and whether that would exclude <br />elevators, storage and unfinished basements. <br /> <br />Keany asked Staff if the language should be changed to floor area instead of structure. <br /> <br />City Attorney Light stated that if the language were changed to floor area, more of the <br />ordinance sections would have to be changed. He commented that on Version C, Section <br />A, the last sentence could be changed to "Further for the purposes of this section only, <br />"habitable" floor area below ground level is considered part of a structure." <br /> <br />Davidson suggested that after discussion is completed, the Ordinance be clarified by the <br />City Attorney and any action be continued to the next Council meeting. <br /> <br />Howard stated that Council could vote for or against the Ordinance with provisions that <br />the City Attorney and City Administrator make the necessary language changes and the <br />Mayor would be authorized to make final apprOval. <br /> <br />City Attorney Light stated that he would counsel against such action. He stated that <br />Council needs to see exactly what they are to enact. <br /> <br />MOTION: Mayer moved that Council continue Ordinance No. 1341, Series 2000, <br />Version C, to the next Council meeting, and direct Staff to include a 2-year <br />grandfathering clause of approved PUD's, and for the issue of the habitable space be <br />resolved in the document, seconded by Howard. <br /> <br />Howard asked about the issue of floor area ratio. <br /> <br /> <br />
