Louisville City Council Meeting <br />September 19, 2000 <br />Page 8. <br /> <br />Mayer stated that it would be addressed under habitable space and asked Howard if he <br />preferred the term floor area ratio. Howard agreed it was addressed under habitable <br />space. <br /> <br />Keany asked for a vote on the parking space fee, which would be included in the revised <br />ordinance. <br /> <br />City Attorney Light advised there should be a vote on the motion and a follow-up motion <br />establishing the parking space fee. <br /> <br />VOTE: All in favor. <br /> <br />City Attorney counseled that a motion directing the ordinance be revised with a proposed <br />fee and the issue of restaurant use be addressed. <br /> <br />MOTION: Keany moved that Council direct the City Attorney to prepare the ordinance <br />for final determination and reflect a $'7,500 per space parking fee. The motion was not <br />seconded. <br /> <br />MOTION: Howard moved that Council set the fee at $10,500, seconded by Mayer. <br />Roll call vote was taken. Motion passed by a vote of 6-l. Keany voted no. <br /> <br />MOTION: Sisk moved that Council direct the City Attorney be directed to incorporate <br />into Version C of the Ordinance, the language of Version B, Section 17.20.025, which <br />excludes a freestanding building solely occupied for use as a restaurant usage, seconded <br />Brown. <br /> <br />Keany stated that non-freestanding restaurants were excluded because they could be <br />converted to another use. He felt that other restaurants could also convert to other uses. <br /> <br />Sisk amended his motion that it must be a restaurant use and if converted to something <br />else, it would be subject to the parking requirements. <br /> <br />Brown accepted the amendment. <br /> <br />Keany asked City Attorney Light how that provision would be written. Light stated that <br />the other portion of the Municipal Code extends parking requirement to a conversion of <br />use. Therefore, it would be addressed outside of the land use application. <br /> <br />Planning Director Wood stated that it would be flagged at the building permit and <br />business license process. <br /> <br /> <br />
