Louisville City Council Meeting
October 17, 2000
Page 8.

RESOLUTION NO. 60, SERIES 2000 - A RESOLUTION APPROVING A
PRECURSOR TEMPORARY USE PERMIT LOT 11-12, BLOCK 10,
CALEDONIA PLACE & ADJACENT MINOR RIGHT-OF-WAY (STATE FARM
INSURANCE - 1314 MAIN STREET)

Davidson called for Staff presentation.

Planning Director Paul Wood reviewed that Resolution No. 60, Series 2000, if
authorized, will allow a Temporary Use Permit to be approved for the applicant, Wendy
Fickbohm. He noted that the applicant received PUD and SRU approval for a new,
larger building and related site improvements in July of 2000. Wood noted that the
existing building must be demolished before the new building can be constructed, which
requires a Temporary Use Permit (TUP) for continued operation of the insurance agency
business in a modular trailer. The temporary office trailer is considered a "precursor
temporary use." Precursor uses can be reviewed administratively for periods up to 30
days however; requests for longer permits require approval through the Planning
Commission and City Council public hearing process.

Wood noted that construction would be phased and specifically addressed in the TUP.
The TUP would not become effective until the Lafayette Street driveway improvements
are complete and would end by August 15, 2001 or when a certificate of occupancy is
issued on the new building, whichever occurs first. Wood reviewed the Louisville Fire
Protection Districts three conditions for approval, which the applicant has met. He noted
that the Planning Commission has also reviewed and recommended approval of the
Temporary Use Permit request.

COUNCIL COMMENTS

Sisk asked Planning Director Wood if any additional signage is contemplated. Wood
stated that there would be no additional signage.

MOTION: Sisk moved that Council approve Resolution No. 60, Series 2000, seconded
by Brown.

City Attorney Light offered a friendly amendment that because the temporary trailer will
be partially on City property, the applicant identifies that the City will not be liable or
responsible for any injuries or damages that may occur on the property.

Sisk and Brown accepted the friendly amendment.

8
