City Council Meeting Minutes April 3, 2012 Page 9of14 Councilor Sackett stated it was obvious the homeowner was not aware of the regulations; however the homeowner disregarded the rules. He stated the Council is bound to uphold the City policies and the Codes. Councilor Dalton agreed and noted the Council made a lot of concessions for the Parbois PUD. He did not feel it was appropriate to grant this request. Mayor Muckle noted the permit clearly allowed a detached garage, but not a living dwelling. He did not support the request. City Attorney Light outlined the finding options. Section 3 includes a finding of lot size and setbacks are not warranted. Section B includes findings the request does not meet the PUD criteria requirements. He noted there are two options available to the City Council; one to deny the request and the second to approve the request. Councilor Jasiak requested clarification on the findings. City Attorney Light explained there are findings for the Board of Adjustment for a variance, such as a self imposed hardship, and criteria for findings for PUD amendments. Mayor Pro Tem Dalton stated the Board of Adjustment denied this application and he did not feel it was appropriate for the Council to overrule the Board of Adjustment. Councilor Loo stated she had read the resolution thoroughly and was satisfied with the draft resolution for denial. MOTION: Councilor Loo moved to approve Resolution No.29, Series 2012, for denial of the minor subdivision plat and amendment to the Parbois Place Planned Unit Development. Mayor Pro Tern Dalton seconded the motion. APPLICANTS COMMENTS Richard Lopez stated he had given up on this project when the former Mayor and the Planning Director suggested this solution to this problem. He noted the applicant spent a substantial amount of time on this application. VOTE: All were in favor. Absent: Councilor Yamell. BI-MONTHLY ECONOMIC DEVELOPMENT UPDATE Mayor Muckle requested a staff presentation. Economic Development Director Star updated Council on the economic developments in Louisville for the months of February and March as follows: • The Council approved seven Business Assistance Agreements this year.
