City Council <br /> Meeting Minutes <br /> April 3, 2012 <br /> Page 9of14 <br /> Councilor Sackett stated it was obvious the homeowner was not aware of the <br /> regulations; however the homeowner disregarded the rules. He stated the Council is <br /> bound to uphold the City policies and the Codes. <br /> Councilor Dalton agreed and noted the Council made a lot of concessions for the <br /> Parbois PUD. He did not feel it was appropriate to grant this request. <br /> Mayor Muckle noted the permit clearly allowed a detached garage, but not a living <br /> dwelling. He did not support the request. <br /> City Attorney Light outlined the finding options. Section 3 includes a finding of lot size <br /> and setbacks are not warranted. Section B includes findings the request does not meet <br /> the PUD criteria requirements. He noted there are two options available to the City <br /> Council; one to deny the request and the second to approve the request. <br /> Councilor Jasiak requested clarification on the findings. City Attorney Light explained <br /> there are findings for the Board of Adjustment for a variance, such as a self imposed <br /> hardship, and criteria for findings for PUD amendments. <br /> Mayor Pro Tem Dalton stated the Board of Adjustment denied this application and he <br /> did not feel it was appropriate for the Council to overrule the Board of Adjustment. <br /> Councilor Loo stated she had read the resolution thoroughly and was satisfied with the <br /> draft resolution for denial. <br /> MOTION: Councilor Loo moved to approve Resolution No.29, Series 2012, for denial of <br /> the minor subdivision plat and amendment to the Parbois Place Planned Unit <br /> Development. Mayor Pro Tern Dalton seconded the motion. <br /> APPLICANTS COMMENTS <br /> Richard Lopez stated he had given up on this project when the former Mayor and the <br /> Planning Director suggested this solution to this problem. He noted the applicant spent <br /> a substantial amount of time on this application. <br /> VOTE: All were in favor. Absent: Councilor Yamell. <br /> BI-MONTHLY ECONOMIC DEVELOPMENT UPDATE <br /> Mayor Muckle requested a staff presentation. <br /> Economic Development Director Star updated Council on the economic developments <br /> in Louisville for the months of February and March as follows: <br /> • The Council approved seven Business Assistance Agreements this year. <br />
