Local Licensing Authority <br />Minutes <br />February 27, 2012 <br />Page 4of 5 <br />Carlson suggested marking an area from the doors to the patios. Lipton <br />wondered about chaining off the patios and a way to identify where the <br />beverages came from. <br />Sergeant Lanphere suggestedhaving the walkway on the patios and tables on <br />the sidewalk. <br />Jim Cohen, owner of the Empire recalledwhen he got the first license for the <br />temporary patios;the onus for controlwas on the licensee. He has not had <br />issues. He ensuresthe servers are the ones who cross the sidewalk;not <br />patrons. <br />Chris Pritchard, 1125 W. Enclave Circle, Louisville, CO introduced himself to the <br />Authority. He brought the patios forward for the Downtown Business Association <br />(DBA) and mentioned he is a member of Planning Commission. He stated the <br />licensees are tasked with policing their patio area. Hewondered about opening <br />up the sidewalk area with a restriction for still staying in their area. There was <br />discussion about the restriction of hours on the patios. <br />Police Chief Goodman suggested the issue totackle was the sidewalk area. <br />Authority Attorney Culley was asked to research State law and see what could be <br />done about the sidewalk area andlicensing. <br />Chairperson Wilson reiteratedthe Authority would like the patios closer to the <br />establishments and the walkway near the street. <br />CDiscussion/Direction -AN ORDINANCE AMENDING SECTION <br />. <br />5.08.030 OF THE LOUISVILLE MUNICIPAL CODE AUTHORIZING <br />THE LOCAL LICENSING AUTHORITY TO ISSUE AND GRANT <br />BREW PUB AND VINTNER’S RESTAURANT LICENSES AND <br />OTHER LIQUOR LICENSES AUTHORIZED BY STATE STATUTE <br />AND REPEALING AND AMENDING OUTDATED PROVISIONS OF <br />THE LOUISVILLE MUNICIPAL CODE CONCERNING ALCOHOL <br />BEVERAGES–fees for same <br />Authority Attorney Culley explained staff noticed the Louisville Municipal Code <br />(LMC) does not include Brewpubs in the list of licenses the Authority could <br />approve.In reviewing the section of the Code, there was also a need to add <br />Vintner’s Restaurant licenses and to clean up some outdated wording and make <br />the Code reflect State Statute. <br />Wilson pointed out under Beer and Wine license, the wordingneeded to be <br />changed from “shall” to “may” be issued. <br /> <br />
