Local Licensing Authority <br />Minutes <br />November 28, 2011 <br />Page 3of 3 <br />C.Incident Report –Down Under –11/4/11 <br />This incident involved police response to a report of a beer company representative <br />serving ata tastingin the liquor store. Discussion centered on the law concerning who <br />could serve at a tasting. Members concluded the licensee or an employee had to do <br />the serving. Theyunderstood how a representative of the brewer would be involved in <br />the tasting and feel compelled to help out. The conclusion was the warning by the <br />police department was appropriate and there was no desire for further action. Carlson <br />suggested the tastings restrictions be addressed in the training provided by the police <br />department. <br />Authority Attorney Culley pointed out C.R.S. §12-47-901(7)(a) may have been violated <br />by giving free beer andinfluencingthe purchase. Discussion centered onwhether <br />there reallywas a violation, knowing other establishments have brewers in and have <br />given free beer with apurchase; is it really influencing the purchase or just marketing. <br />For future reference, the Authority asked Attorney Culley to do some research and help <br />them determine if this was a violation. <br />Secretary’s Report <br />Secretary Hanson noted she had included the schedule for next year’s meetings. She <br />included a synopsis of the state enforcement results and had the stipulations, <br />agreements and orders if anyone was interested. There was a report on the November <br />seller/server training. Hanson thanked the police department for holding the class and <br />noted Chairperson Gunning had attended. <br />Gunning commented he found it helpful to attend the training. <br />Authority Attorney’s Report <br />No report. <br />Authority Comment <br />No comments <br />Discussion Items for Next Meeting–December 19, 2011– <br />Authority members <br />agreed to cancel the December meeting. Secretary Hanson said the only item she had <br />pending was a special events permit in mid December,which could be done <br />administratively. <br />Adjourn <br />–Gunningmoved to adjourn. Carlsonseconded. All in favor.
