City Council <br /> Meeting Minutes <br /> May 1, 2012 <br /> Page 16 of 17 <br /> Mayor Pro Tern Dalton asked what are the ramifications should Council decide to deny <br /> this application. City Attorney Light explained, if the Council remands the application <br /> back to the Planning Commission, the amended application can be reviewed and a <br /> recommendation from the Planning Commission would be brought forward. If Council <br /> denies the application, it would require the applicant file a new application. <br /> Mayor Pro Tem Dalton asked if Council denies the application, what would be the next <br /> step for the applicant. Planning Director Russ stated it would require the applicant to re- <br /> file the application, which entails a six-month process. <br /> Councilor Jasiak noted this is the first time Council has had an opportunity to review the <br /> proposal. She thanked the public, the developer and City staff for their patience. <br /> MOTION: Mayor Muckle moved to continue the public hearing to May 15, 2012, <br /> seconded by Mayor Pro Tem Dalton. All were in favor. <br /> ATTORNEY'S REPORT <br /> No items to report. <br /> COUNCIL COMMENTS, COMMITTEE REPORTS, AND IDENTIFICATION OF <br /> FUTURE AGENDA ITEMS <br /> Mayor Pro Tem Dalton reported a Longmont City Council member contacted him <br /> relative to a Boulder County Social event for elected officials. The date selected is <br /> Friday, May 11th and the time would be sometime in the afternoon. <br /> City Attorney Light stated the Loftus proposal public hearing has been continued to May <br /> 15m. He cautioned Council not to discuss this matter with members of the public. <br /> Council member Sackett felt he should be allowed to discuss current topics with the <br /> public. Mayor Muckle explained the Council is required to respond to questions and <br /> make final decisions in open meetings. <br /> City Attorney Light explained there are special rules for Council decisions on land use <br /> applications. He explained it is a quasi-judicial action, which is similar to a Court <br /> proceeding. Council has a legal obligation to have discussion and make decisions in a <br /> meeting open to the public. <br /> ADJOURN <br /> MOTION: Mayor Pro Tem Dalton moved for adjournment, seconded by Mayor Muckle. <br /> All were in favor. The meeting was adjourned at 10:27 p.m. <br />
