Section 3: Hearings. All appeal hearings shall be open to the public and shall require <br />prior public notice as set forth in Article IV, Section 3. The procedure for an appeal <br />hearing shall be set forth in Article IV, Section 4. <br />Section 4: Decision on Appeal. After conducting a hearing and upon review of the <br />evidence presented, including the City Zoning Ordinance, the Board may affirm, <br />reverse, or modify the order, requirement, decision, or determination appealed. The <br />Board may render its decision immediately or take the matter under advisement for <br />further deliberations, All findings or order of the Board must comply with the Zoning <br />Ordinance of the City of Louisville. <br />ARTICLE VIII <br />VARIANCES <br />Section 1: Variances. The Board shall hear and decide applications for variances from <br />the provisions of Title 17 of the Louisville Municipal Code. In granting any variance, the <br />Board may attach such reasonable conditions and safeguards as it deems necessary to <br />implement the purposes of Title 17. The Board may grant a variance only if it makes <br />findings that all of the following requirements, insofar as applicable, have been satisfied: <br />1. That there are unique physical circumstances or conditions such as <br />irregularity, narrowness or shallowness of lot, or exceptional topographical or <br />other physical conditions peculiar to the affected property, <br />2. That the unusual circumstances or conditions do not exist throughout the <br />neighborhood or district in which the property is located, <br />3. That because of such physical circumstances or conditions, the property <br />cannot reasonably be developed in conformity with the provisions of Title 17 <br />of the Louisville Municipal Code, <br />4. That such unnecessary hardship has not been created by the Applicant, <br />5. That the variance, if granted, will not alter the essential character of the <br />neighborhood or district in which the property is located, nor substantially or <br />permanently impair the appropriate use or development of adjacent property, <br />6. That the variance, if granted, is the minimum variance that will afford relief <br />and is the least modification possible of the provisions of Title 17 of the <br />Louisville Municipal Code which are in question. <br />Section 2: Hearings. All variance hearings shall be open to the public. Within five (5) <br />working days of the receipt of an application for a variance and payment of the required <br />filing fee, which shall be one -half of the zoning amendment fee, the date of the variance <br />hearing will be set. <br />Section 3: Appearance. Any party to a variance application may appear before the <br />Board in person or by agent or by attorney. <br />10 <br />
