A. Chairperson opens the hearing, announces the subject matter of the <br />hearing and describes the procedure for conducting the hearing. <br />B. Determination of compliance with application and public notice <br />requirements. <br />C. Board member disclosure of site visits, ex parte contacts, and conflicts of <br />interest. <br />D. Introduction of previously received exhibits and appropriate documents <br />into the record by the Secretary, including, if applicable, the application, staff reports, <br />reference maps and plans, and applicable code sections by reference. <br />E. City Staffs presentation of its position, followed by Board questions <br />(Fifteen (15) minutes). <br />F. Applicant's presentation of its position, followed by Board questions. <br />(Fifteen (15) minutes). <br />G. Testimony by any persons in the audience supporting or opposing the <br />application. (Three (3) minutes per person). <br />H. Applicant rebuttal and closing statement. (Ten (10) minutes). <br />I. Board questions of applicant or staff. <br />J. Close of public hearing. <br />K. Board discussion. <br />L. Board action, as permitted by ordinance. <br />The Board may extend these individual limitations upon approval of a majority of the <br />Board, or the Chair may extend the limits as the Chair deems necessary to ensure that <br />parties receive a full and fair opportunity to be heard. <br />ARTICLE VII <br />APPEALS FROM DECISIONS BY ZONING ADMINISTRATOR <br />Section 1: Appeals. The Boards shall be responsible for any appeal of an order, <br />requirement, decision or determination of the zoning administrator. Said appeal may be <br />taken by any person aggrieved by such action, or by an officer of the City affected by <br />such decision. <br />Section 2: Time for Filing Appeals. Pursuant to Section 17.48.090 of the Louisville <br />Municipal Code, any appeal to the Board concerning any order, requirement, <br />determination or decision of the zoning administrator shall be filed with the Board of <br />Adjustment no later than thirty (30) days from the date of decision being appealed. Said <br />appeal shall be commenced by the aggrieved party filing a written notice of appeal with <br />the zoning administrator and with the Secretary of the Board. The appeal should be <br />conducted as a public hearing pursuant to these bylaws. <br />9 <br />
