Prior to any rehearing, the Board shall cause proper notice thereof to be given as <br />provided in Section 3 of Article IV of these bylaws, <br />Section 10: Order of Public Hearing. The suggested procedure for the variance <br />hearing shall be as follows: <br />1. Chair opens public hearing. <br />2. Opening Statement by Chair <br />The Chair of the Board shall state the purpose of the hearing and describe <br />the procedure for conducting the hearing. <br />3. Determination of proper notice and application. <br />The Board shall determine whether notice requirements have been <br />satisfied and whether the Applicant has properly filed the application for a <br />variance. <br />4. Board member disclosures <br />5. City Staff Presentation <br />The Board, City Attorney, the Applicant, and parties who favor or opposed <br />the application may question City Staff. <br />6. Applicant's Presentation <br />The Board, City Staff, City Attorney, and parties opposed to the <br />application may question the Applicant. <br />7. Statements to the Board by persons in favor of the application <br />The Board, City Staff, City Attorney, and parties opposed to the <br />application may question those making statements to the Board in favor of <br />the application. <br />8. Statements to the Board by persons opposed to the application <br />The Board, City Staff, City Attorney, the Applicant, and parties who favor <br />the application may question those making statements to the Board <br />opposed to the application. <br />9. Rebuttal by Applicant <br />Questions of the Applicant by those identified in paragraph 5, above. <br />'10. Closing Statements by Applicant and City Staff. <br />11. Close the Public Hearing <br />12. Board comment and decision on merits or to take the matter under <br />advisement <br />Section 11: Communications. Prior to a variance hearing, the Board may receive from <br />the City Staff a copy of the application, staff report and notice of the hearing. No other <br />12 <br />
