engineering, the sanitary sewer line extension crossing South 88th Street and parallel to South 88th Street to serve the School Campus Parcel and the Development Parcels. 11. South 88th Street Bridge. The City shall pursue with the County of Boulder and the Colorado Department of Transportation replacement of the South 88th Street bridge over U.S. 36. 12. Proposed East/West Road Right of Way and Water Line. The School District shall dedicate to the City, by General Warranty Deed, at the City's request, a seventy (70) foot wide strip of land for use as an east/west road right-of-way (to be named later) and for an east/west water line extension. The School District shall construct, in accordance with the City's public improvement standards, at no cost to the City, a roadway east from South 88th Street to the east access point of the parking lot on the School Campus Parcel. The roadway will not include curb, gutter, or sidewalks. The School District shall extend, at no cost to the City, a twelve (12") inch water line easterly from South 88th Street to the east boundary of the School Campus Parcel. The City shall not assess any costs against the Property, the School District or the owners or developers of the Development Parcels for future improvements (if any) made by the City to the east/west road right-of-way (to be named later) or to the water line installed by the School District. 13. Obligations of Development Parcels. Except as expressly provided herein, the owners of the Development Parcels and the developers thereof shall comply with all applicable City ordinances, regulations and fees. 14. Cooperation. The parties agree that they will cooperate with one another in accomplishing the terms, conditions, and provisions of this Agreement, and will execute such additional documents as may be necessary to effectuate the same. 15. Amendments. This Agreement may be amended only by the written agreement of the parties. 16. Entire Agreement. This Agreement embodies the entire agreement of the parties in relation to the Property. There are no promises, terms, conditions, or obligations other than those contained herein; and this Agreement supersedes all previous communications, representations, or agreements, either verbally or written, between the parties in relation to the Property. 17. Binding Effect and Value. This Agreement shall be binding upon and inure to the benefit of the heirs, transferees, June 27, 1996 BVSD\GEN\BVSD2.RAE 5
