engineering, the sanitary sewer line extension crossing South <br />88th Street and parallel to South 88th Street to serve the School <br />Campus Parcel and the Development Parcels. <br />11. South 88th Street Bridge. The City shall pursue with <br />the County of Boulder and the Colorado Department of <br />Transportation replacement of the South 88th Street bridge over <br />U.S. 36. <br />12. Proposed East/West Road Right of Way and Water Line. <br />The School District shall dedicate to the City, by General <br />Warranty Deed, at the City's request, a seventy (70) foot wide <br />strip of land for use as an east/west road right-of-way (to be <br />named later) and for an east/west water line extension. The <br />School District shall construct, in accordance with the City's <br />public improvement standards, at no cost to the City, a roadway <br />east from South 88th Street to the east access point of the <br />parking lot on the School Campus Parcel. The roadway will not <br />include curb, gutter, or sidewalks. The School District shall <br />extend, at no cost to the City, a twelve (12") inch water line <br />easterly from South 88th Street to the east boundary of the <br />School Campus Parcel. The City shall not assess any costs <br />against the Property, the School District or the owners or <br />developers of the Development Parcels for future improvements (if <br />any) made by the City to the east/west road right-of-way (to be <br />named later) or to the water line installed by the School <br />District. <br />13. Obligations of Development Parcels. Except as <br />expressly provided herein, the owners of the Development Parcels <br />and the developers thereof shall comply with all applicable City <br />ordinances, regulations and fees. <br />14. Cooperation. The parties agree that they will <br />cooperate with one another in accomplishing the terms, <br />conditions, and provisions of this Agreement, and will execute <br />such additional documents as may be necessary to effectuate the <br />same. <br />15. Amendments. This Agreement may be amended only by the <br />written agreement of the parties. <br />16. Entire Agreement. This Agreement embodies the entire <br />agreement of the parties in relation to the Property. There are <br />no promises, terms, conditions, or obligations other than those <br />contained herein; and this Agreement supersedes all previous <br />communications, representations, or agreements, either verbally <br />or written, between the parties in relation to the Property. <br />17. Binding Effect and Value. This Agreement shall be <br />binding upon and inure to the benefit of the heirs, transferees, <br />June 27, 1996 <br />BVSD\GEN\BVSD2.RAE <br />5 <br />
