Louisville City Council Meeting <br />December 5, 2000 <br />Page 13. <br /> <br />Russ Rowe, Davis, Graham & Stubbs, 1550 15th Street, Suite 500, Denver, CO, Attorney <br />representing Qwest Wireless, provided Council with a photograph of the proposed <br />monopole. He reviewed that the Qwest request entails a proposal for a 60' pole and two <br />equipment cabinets at the base, which are screened by a cedar wood fencel He <br />introduced three Qwest experts: Dallas Kiland, Construction Manager, Emad Abuqabaita, <br />Radio Frequency Engineer, and Katie Myers, Real Estate Manager who were available to <br />answer technical questions. <br /> <br />Rowe stated that Qwest is requesting approval, contrary to the recommendation of Staff <br />and the Planning Commission, of an Alternative Tower Structure site for personal <br />wireless service facility at the Storage Technology location. He reviewed the Special <br />Review Use to permit a 60-foot tall monopole with a fully concealed antennae array. <br /> <br />Rowe stated that Qwest has filed the Special Review Use application because it is <br />necessary to foster the expansion of personal wireless services in the Louisville area. <br />He noted that local land use regulations and zoning ordinances will be followed, however <br />there cannot be any discrimination among the providers, nor can they prohibit personal <br />wireless services. He quoted the City intent "to provide a high level of <br />telecommunication services for the citizens." Rowe stated that Qwest cannot meet their <br />obligation without the ATS that is proposed. He stated that Qwest has fully complied <br />with the requirements of the ordinance in its application for a Special Review Use and the <br />Amendment of a Final PUD Development Plan. Rowe stated that Staff and the Planning <br />Commission's denial were based on the monopole not being a ATS. He noted that ATS <br />towers were developed to conceal the antenna. He noted that this particular tower is an <br />exposed pole due to its location in an industrial zoned area and there are many utility <br />poles in the vicinity of the Public Service substation. <br /> <br />Rowe stated that there are no alternatives or solutions possible. He noted the two <br />alternatives suggested by Staff, one a parking lot, which will not provide the coverage <br />and the second, was Flatiron Crossing Mall. He stated that that the mall would not work <br />because of their demand of immediate termination rights at any time, and removal of the <br />tower. He stated that there is no way to guarantee coverage with any alternative that was <br />researched. He noted that there has been no public opposition. The only objection voiced <br />was by the Louisville Planning Commission. <br /> <br />Rowe stated that Qwest's personal wireless phone customers have no signal and therefore <br />no service south of Louisville. He noted that Qwest Engineers have visited and analyzed <br />this area and determined the ideal location for an antenna site would be on the eastside of <br />the Public Service substation.
