City Council <br /> Meeting Minutes <br /> May 15, 2012 <br /> Page 4 of 11 <br /> MOTION: Mayor Muckle moved to direct the LHA Board and City staff to draft, for <br /> Council consideration, an IGA, between the LHA, BCHA and the City, to transfer current <br /> assets and liabilities to BCHA, seconded by Mayor Pro Tern Dalton. All were in favor. <br /> RESOLUTION No. 25, SERIES 2012 — A RESOLUTION APPROVING A <br /> PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) AND SPECIAL REVIEW <br /> USE (SRU) TO PERMIT THE CONSTRUCTION OF FIVE (5) BUILDINGS, THREE (3) <br /> OF WHICH WILL CONTAIN A TOTAL OF 180 APARTMENT UNITS AND <br /> STRUCTURED PARKING, AND TWO (2) OF WHICH WILL CONTAIN 10,000 <br /> SQUARE FEET OF RETAIL DEVELOPMENT, ON TRACT ONE OF THE LOUISVILLE <br /> NORTH, FILING 7 SUBDIVISION LOCATED AT 707 E. SOUTH BOULDER ROAD <br /> Mayor Muckle explained the applicant had a medical emergency preventing him from <br /> being present this evening and Council cannot make a final decision without the <br /> applicant present. He stated Council's final action on the proposal will be continued to <br /> the June 5, 2012 meeting. He outlined the process for the public hearing as follows: <br /> The City staff and applicant make their presentations and then the public is allowed to <br /> make comments. He would allow the public to speak this evening. Mayor Muckle re- <br /> opened the public hearing. <br /> City Attorney Light requested the Council, by motion, include in the record of the <br /> proceeding the following additional documents: All the materials included in the May <br /> 15`h packet, staff communication and attachments, additional documents filed by the <br /> applicant and all additional public comments, including email correspondence received <br /> by members of the public. <br /> MOTION: Mayor Muckle moved to include all the documents outlined by the City <br /> Attorney into the records, seconded by Mayor Pro Tem Dalton. All were in favor. <br /> Staff Presentation: Planning Director Russ explained at the May 1, 2012 City Council <br /> meeting, staff made a presentation on the Loftus proposal. The City Council continued <br /> the public hearing to May 15, 2012. No additional information was requested by City <br /> Council. He explained as staff concluded their presentation at the last meeting they do <br /> not have a presentation for this evening. <br /> Mayor Muckle requested any Council member, who requires any additional technical <br /> information on this project, to inform the staff prior to the June 5, 2012 meeting. <br /> PUBLIC COMMENT <br /> John S. Nahodyl, 2333 Dogwood Circle, Louisville, CO addressed the major points the <br /> developer brought up at the May 1, 2012 meeting, which included the following: height, <br /> egress, traffic congestion, removal of trees and sidewalk. He stated the developer has <br /> made some small changes over the last several months. He stressed the project is not <br /> a good fit for the City of Louisville. <br />
