ORDINANCE NO. 1614 <br /> SERIES 2012 <br /> AN ORDINANCE AMENDING SECTIONS 17.16.030 AND 17.16.130 OF THE <br /> LOUISVILLE MUNICIPAL CODE TO CHANGE THE MINIMUM BUILDING <br /> SEPARATION REQUIREMENTS FROM TEN FEET TO FIVE FEET <br /> WHEREAS, the City of Louisville is a home rule municipal corporation organized under <br /> and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; <br /> and <br /> WHEREAS, Subsection C of Section 17.16.030 of the Louisville Municipal Code <br /> (LMC) requires accessory structures be separated from primary structures, either on the same lot <br /> or on a different lot, by a minimum of ten (10) feet; and <br /> WHEREAS, Section 17.16.130 of the LMC requires primary structures be separated <br /> from other primary structures on the same lot by a minimum of ten (10) feet; and <br /> WHEREAS, City staff, the design community, and the Louisville Citizenry have found <br /> the requirements of Sections 17.16.030 and 17.16.130 of the LMC to be overly restrictive; and <br /> WHEREAS, the International Building Code (IBC) adopted by the City sets building <br /> separation requirements based on construction materials; and <br /> WHEREAS, the City desires to better align the requirements of the LMC with those of <br /> the IBC; and <br /> WHEREAS, the Louisville Fire District does not require a minimum separation between <br /> buildings on the same lot; and <br /> WHEREAS, staff of the Planning Department, Building Safety Division, and Fire <br /> District have determined that a minimum five (5) foot separation between buildings is sufficient <br /> to ensure safety and aesthetic quality for residential buildings; and <br /> WHEREAS, residential areas in the City are undergoing redevelopment and a ten foot <br /> minimum separation requirement limits the redevelopment potential of many homes; and <br /> WHEREAS, commercial areas of the City are not facing the same pressures and would <br /> be better served by a ten foot building separation; and <br /> WHEREAS, the LMC will be clearer and easier to follow if language explicitly dealing <br /> with eaves and overhangs is added; and <br /> WHEREAS, after a duly noticed public hearing held April 12, 2012, where evidence and <br /> testimony were entered into the record, including the findings in the Louisville Planning <br /> Commission Staff Report dated April 12, 2012, the Louisville Planning Commission has <br /> Ordinance No. 1614, Series 2012 <br /> Page 1 of 3 <br />
