LEASE AGREEMENT
<br />THIS LEASE AGREEMENT (hereinafter "Lease ") is made and entered effective as of the
<br />17th day of July, 2012, by and between the City of Louisville, a Colorado municipal corporation
<br />(hereinafter "Lessor ") and the Roland Radcliff, whose address is P.O. Box 264, Louisville, Colorado
<br />80027 (hereinafter "Radcliff "), and Karim Amirfathi, 7150 South Boulder Road, Boulder, Colorado
<br />80303, hereinafter collectively "Lessee ").
<br />WHEREAS, Lessor is the owner of certain real property described as Lot 6, Block 4, Town
<br />of Louisville, County of Boulder, State of Colorado, which lot has an address of 611 Front Street,
<br />Louisville, Colorado and upon which property is located a one -story frame building containing an
<br />upholstery shop and retail grocery; and
<br />WHEREAS, Lessee wishes to enter into a two -year lease for the property; and
<br />WHEREAS, Lessor is authorized to enter into this Lease pursuant to its home rule charter
<br />and other applicable law;
<br />NOW, THEREFORE, the Lessor and Lessee agree as follows:
<br />1. Leased Premises. In consideration of the payment of rent and performance of the
<br />covenants and agreements set forth in this Lease, the Lessor leases to Lessee that certain real
<br />property described as Lot 6, Block 4, Town of Louisville, County of Boulder, State of Colorado and
<br />having a street address of 611 Front Street, Louisville, Colorado, 80027, together with improvements
<br />and any furniture or equipment of Lessor located thereon (hereinafter the "Leased Premises ").
<br />2. Term. The term of this Lease shall be two (2) years commencing on the I st day of
<br />September, 2012 and continuing until August 31, 2014, subject to Lessor's rights of earlier
<br />termination as provided herein. After August 31, 2014, the lease becomes a month -to -month lease
<br />which can be terminated by either Lessor or Lessee upon 30 days' prior written notice or as provided
<br />in this Lease.
<br />3. Purposes. The Leased Premises may be occupied and used by Lessee pursuant to this
<br />Lease solely for the following purposes: an upholstery shop, retail grocery, and associated garden.
<br />4. Rent and Utilities. As consideration for this Lease, Lessee shall pay the Lessor rent in
<br />the amount of $400.00 per month, payable in advance on the 1st day of each month. Such amount
<br />shall be a flat rent for each month, and shall not be prorated based on the number of days in each
<br />rental period. Rent shall be payable to the City of Louisville, 749 Main Street, Louisville, Colorado,
<br />80027, or to such other address as directed by Lessor. Rent not paid by the 10th day of the month
<br />shall be subject to a late fee of $20.00. In addition to rent, Lessee shall be solely responsible for
<br />payment of, and shall directly pay to the providers when due, all utility charges for water, sewer, gas,
<br />electric, cable, telephone, trash and other services for the Leased Premises.
