Louisville City Council Meeting <br />January 2, 2001 <br />Page 10. <br /> <br />City Attorney Light stated that if there is a long existing access off Highway 42 and it is <br />closed, the property owner of residential use, is entitled to access somewhere else. <br /> <br />Davidson clarified that the current access from Highway 42 is the historic access right for <br />this residential driveway~ <br /> <br />Light asked if the additional 8' of access easement would be immediately available for <br />emergency vehicles. He stated that the original 20' is for public access, therefore the <br />additional 8' should be subject to access for emergency vehicles. <br /> <br />Davidson suggested an amendment that condition number 3 of Resolution No. 2, be left <br />as written and Council instruct the City Attorney and Staff to work out the details, subject <br />to the Mayor's approval. <br /> <br />Sisk accepted the amendment. <br /> <br />Davidson called for a second on the motion. <br /> <br />Brown seconded the motion. <br /> <br />Davidson restated the motion: Council approve Resolution No. 2, Series 2001, and <br />authorize the City Attorney and Staff to modify condition No. 3, subject to the Mayor's <br />approval. <br /> <br />Mayer asked for clarification that the agreement is that in return for the additional 8' <br />access, the application will have a lower open space dedication somewhere else and that <br />the future open space dedication is reduced in order to have the 8' access easement. <br /> <br />Brown stated that was his understanding. <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 4-1. Mayer voted no. <br />Absent - Howard, Keany - excused. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Sam Light reported that the Public Utilities Commission has denied the <br />City's Motion to Dismiss the Public Service Company's Petition. He noted that there <br />would be comments heard in Louisville on January 17, 2001, followed by a formal <br />hearing on Public Service's application on the following day. <br /> <br />10 <br /> <br /> <br />
