<br />ORDINANCE NO. 1195 <br />SERIES 1995 <br /> <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE <br />MUNICIPAL CODE TO ESTABLISH AN OLD TOWN OVERLAY ZONE <br />DISTRICT, TO AMEND THE ZONING DISTRICT MAP OF THE CITY, <br />TO PROVIDE FOR ADDITIONAL DEFINITIONS, TO AMEND THE <br />NONCONFORMING USE PROVISIONS AND TO MAKE OTHER AMENDMENTS <br />IN CONNECTION THEREWITH. <br /> <br />WHEREAS, C.R.S. S31-23-301 et ~ authorizes the City to <br />establish zoning districts within the City; and <br /> <br />WHEREAS, the City has established zoning districts and zoning <br />regulations as codified in Title 17 of the Louisville Municipal <br />Code; and <br /> <br />WHEREAS, the historical Old Town area of the City is uniquely <br />characterized by existing lot and building configurations; and <br /> <br />WHEREAS, the adoption of a zoning ordinance in 1962 resulted <br />in the creation of numerous nonconforming properties in Old Town <br />and therefore created compliance difficulties for property owners <br />seeking additions and improvements to their existing homes. Many <br />of the existing ownership parcels in Old Town do not meet current <br />minimum lot area or lot width requirements and many improvements do <br />not comply with the current requirements for front, rear and side <br />yard setbacks, or lot coverage; and <br /> <br />WHEREAS, the unique character of Old Town should be preserved <br />by ensuring that new construction is not out of scale or out of <br />character with existing development in Old Town while providing a <br />balance between the reasonable use of the property and maintaining <br />an appropriate scale and character of development; and <br /> <br />WHEREAS, the City Council desires to establish an overlay zone <br />district and regulations pertaining thereto for the area known as <br />Old Town; and <br /> <br />WHEREAS, the City Council has determined that the creation of <br />an Old Town overlay district is necessary to maintain the existing <br />character of Old Town, to control the scale and intensity of <br />development so that it is consistent with the existing character of <br />Old Town, to maximize design flexibility and streamline the <br />procedural requirements relative to the review and approval of <br /> <br />1 <br />
