<br />needed energy resources from land located within the corporate <br />limits of the City in a manner which minimizes adverse land use <br />impacts; and <br /> <br />WHEREAS, Chapter 17.68 of the Louisville Municipal Code <br />permits the drilling and production of oil and gas wells as a land <br />use within the City subject to certain conditions; and <br /> <br />WHEREAS, the City wishes to allow said resource removal while <br />protecting the safety of persons and use of property located within <br />the corporate limits of the City; and <br /> <br />WHEREAS, the City has examined the effects of oil and gas <br />drilling and production on adjacent residential and business uses; <br />and <br /> <br />WHEREAS, it is necessary to repeal and reenact Chapter 17.68 <br />regarding the development standards for oil and gas exploration, <br />drilling, and production to establish a reasonable and fair balance <br />between the interests of both existing and proposed residential and <br />commercial development and the growth of oil and gas production; <br />and <br /> <br />WHEREAS, it is necessary to repeal and reenact Chapter 17.68 <br />of the Louisville Municipal Code to allow for the adoption of <br />regulations which are consistent with State laws and regulations, <br />and which provide adequate performance standards for oil and gas <br />development within the corporate limits of the City; and <br /> <br />WHEREAS, repealing and reenacting Chapter 17.68 of the <br />Louisville Municipal Code provides the City with comprehensive <br />regulations which allow for the safe extraction of energy resources <br />while ensuring the compatible coexistence of extraction activities <br />and urbanized development within the City; and <br /> <br />WHEREAS, it is the City's intent to provide fair, efficient, <br />and speedy enforcement of any violations of Chapter 17.68 in the <br />City's municipal court; and <br /> <br />WHEREAS, it is the intent of the City that to the extent a <br />matter is not covered in this Ordinance, the general provisions of <br />Title 17 shall apply; and <br /> <br />WHEREAS, it is necessary to amend Chapters 8.24 and 17.16 of <br />the Louisville Municipal Code to allow for the adoption of <br />regulations consistent with the oil and gas regulations; and <br /> <br />WHEREAS, these regulations may be amended from time to time <br />based on amendments that may occur in the future to the oil and Gas <br />Conservation Act; and <br /> <br />2 <br />
