Louisville City Council Meeting <br />January 16, 2001 <br />Page 10. <br /> <br />Mayer concurred with Mayor Davidson and suggested that the Agreement be approved. <br />He requested that if the 96th Street project is delayed, any interests that accrue on the <br />funds be forwarded to the City to help defray any inflationary expenses of the project. <br />Hogan stated that the City may want to talk to other municipalities about that concept. <br />He noted that according the Agreement, the City of Broomfield will not earn interest on <br />the $12 million dollars allocated to the Midway Boulevard project. <br /> <br />Keany asked if the Northwest Parkway would be opened in phases. Hogan stated that <br />according to the contract, the Northwest Parkway will open all at once. <br /> <br />Phare asked for clarification on the portion of 96th Street that is in the City of Louisville <br />and not Broomfield. Hogan confirmed the portion of 96th Street that runs through <br />Louisville. <br /> <br />MOTION: Howard moved that Council approve Resolution No. 3, Series 2001 as <br />amended, seconded by Levihn. <br /> <br />City Attorney Light offered a friendly amendment to add a sentence to the agreement: <br />"The City and the Authority shall enter into future agreements as necessary to implement <br />the terms of Item 2." <br /> <br />Howard and Levihn agreed to the amendment. <br /> <br />VOTE: Roll call vote was taken. The motion by a vote of 7-0. <br /> <br />RESOLUTION NO. 4, SERIES 2001 - FINAL PUD DEVELOPMENT PLAN AND <br />SPECIAL REVIEW USE FOR A 16,750 SQUARE FOOT TWO-STORY <br />BUILDING WITH OFFICE OCCUPANCY ON LOT 3, BLOCK 1, THE <br />BUSINESS CENTER AT CTC <br /> <br />Davidson called for Staff presentation. <br /> <br />Planning Director Paul Wood stated that the application is a Final PUD and a Special <br />Review Use. He reviewed the zoning, which is PCZD for a mix of commercial/industrial <br />uses. The area includes several lots adjacent to the RR tracks, which are zoned for <br />industrial and limited commercial uses, such as offices or restaurants, subject to Special <br />Review Use (SRU) approval. Commercial uses are subject to the design criteria of the <br />CDDSG. Wood noted that the lot size is relatively small and is also encumbered by an <br />easement for the Northern Colorado Water Conservancy District on the western 30 feet <br />of the property, adjacent to the BNSF right-of-way.
