Louisville City Council Meeting <br />February 6, 2001 <br />Page 16. <br /> <br />Mayer suggested that the Staff and the Applicant work on the crossing. He noted that if <br />there is not a satisfactory resolution, the Applicant can come back before the Council. <br /> <br />Davidson suggested adding a condition that states the matter must be resolved prior to the <br />issuance of building permits. He stated that the Public Works Department and the <br />Applicant can work to resolve the issue, with final approval made by the City <br />Administrator. He noted that if the Applicant does not agree with the decision, they can <br />come back before the City Council. <br /> <br />MOTION: Mayer moved that Council approve Resolution 9, Series 2001, with the <br />original condition of the Planning Commission and the additional condition outlined by <br />the Mayor, seconded by Levihn. <br /> <br />Mayer asked the City Attorney to respond to the liability concerns. City Attorney Light <br />stated that it is a public right-of-way. <br /> <br />Light offered a friendly amendment that the Applicants work with Staff to incorporate a <br />safe, crossing mid-street crossing with consideration for project users, to be agreed upon <br />by the Applicant and the City Administrator with Applicant's cost contributions to be <br />agreed upon by the Administrator and Applicant. <br /> <br />Mayer and Levihn accepted the amendment. <br /> <br />Keany commented that he liked the project and thought it was very beneficial for <br />Louisville. <br /> <br />VOTE: Roll calk vote was taken. The motion passed by a vote of 5-0.
