Louisville City Council Meeting February 6, 2001 Page 16. Mayer suggested that the Staff and the Applicant work on the crossing. He noted that if there is not a satisfactory resolution, the Applicant can come back before the Council. Davidson suggested adding a condition that states the matter must be resolved prior to the issuance of building permits. He stated that the Public Works Department and the Applicant can work to resolve the issue, with final approval made by the City Administrator. He noted that if the Applicant does not agree with the decision, they can come back before the City Council. MOTION: Mayer moved that Council approve Resolution 9, Series 2001, with the original condition of the Planning Commission and the additional condition outlined by the Mayor, seconded by Levihn. Mayer asked the City Attorney to respond to the liability concerns. City Attorney Light stated that it is a public right-of-way. Light offered a friendly amendment that the Applicants work with Staff to incorporate a safe, crossing mid-street crossing with consideration for project users, to be agreed upon by the Applicant and the City Administrator with Applicant's cost contributions to be agreed upon by the Administrator and Applicant. Mayer and Levihn accepted the amendment. Keany commented that he liked the project and thought it was very beneficial for Louisville. VOTE: Roll calk vote was taken. The motion passed by a vote of 5-0. Sisk abstained. Howard - excused.
