Section 3.08.065 of the Louisville Municipal Code is hereby amended to read as follows (words added are underlined; words deleted are stricken through): Section 3.08.065. Negotiated contracts. If no bids are received, or if the city council determines that all bids are too high, the city may enter into negotiations concerning a contract. Under no circumstances shall the negotiated price exceed the lowest,best and responsive, responsible bid received during the bidding process at determined by the city. Section 9. Section 3.08.070 of the Louisville Municipal Code is hereby amended to read as follows (words added are underlined; words deleted are stricken through): Section 3.08.070. Bidding-Contract award. Whenever any bid is accepted, the city council shall award the contract to the lowest, best and responsive, reliable and responsible bidder at determined by the city. subject to his furnishing the necessary performance bond and complying with the other requirements which have been determined by the city council and set forth in the proposal. Section 11. This ordinance and the amendments to the Louisville Municipal Code set forth herein shall take effect October 1, 2012. Section 12. If any portion of this ordinance is held to be invalid for any reason, such decisions shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid.
