Section 3.08.065 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words added are underlined; words deleted are stricken through): <br /> Section 3.08.065. Negotiated contracts. <br /> If no bids are received, or if the city council determines that all bids are <br /> too high, the city may enter into negotiations concerning a contract. Under no <br /> circumstances shall the negotiated price exceed the lowest,best and responsive, <br /> responsible bid received during the bidding process at determined by the city. <br /> Section 9. Section 3.08.070 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words added are underlined; words deleted are stricken through): <br /> Section 3.08.070. Bidding-Contract award. <br /> Whenever any bid is accepted, the city council shall award the contract to <br /> the lowest, best and responsive, reliable and responsible bidder at determined by <br /> the city. subject to his furnishing the necessary performance bond and complying <br /> with the other requirements which have been determined by the city council and <br /> set forth in the proposal. Upon such acceptance the bid bonds of other bidders <br /> shall be returned. <br /> Section 10. Section 3.08.080 of the Louisville Municipal Code is hereby amended to <br /> read as follows (words and numbers added are underlined; words and numbers deleted are <br /> stricken through): <br /> Section 3.08.080. Bidding-Default procedure. <br /> If the person whose bid was accepted by the city fails to enter into a <br /> contract, such person's bid bond shall be forfeited to the city, and the city council <br /> may then accept the bid of the next lowest, best and responsive, reliable and <br /> responsible bidder or reject all bids as in its judgment may be best for the interest <br /> of the city. <br /> Section 11. This ordinance and the amendments to the Louisville Municipal Code set <br /> forth herein shall take effect October 1, 2012. <br /> Section 12. If any portion of this ordinance is held to be invalid for any reason, such <br /> decisions shall not affect the validity of the remaining portions of this ordinance. The City <br /> Council hereby declares that it would have passed this ordinance and each part hereof <br /> irrespective of the fact that any one part be declared invalid. <br /> Ordinance No. 1621.Series 2012 <br /> Page 4 of 5 <br />
