<br />City Council <br />Meeting Minutes <br />December 6, 2005 <br />Page 6 of 16 <br /> <br />Mayor Sisk requested public comment. There were no comments. <br /> <br />COUNCIL COMMENT <br /> <br />Council member Marsella stated the Youth Advisory Board members have <br />concerns the ordinance precludes youth groups from soliciting within the City for <br />fund raising projects, and request an exemption for youths under the age of 18. <br />Chief Goodman stated the Council can modify the ordinance to provide <br />exemptions, but stressed it is the residents right to refuse to be bothered by <br />solicitors. <br /> <br />Council member Yarnell asked if youth groups solicited within their neighborhood <br />where they are known by the neighbors, is it the responsibility of the home owner <br />to call the police. Chief Goodman stated the ordinance provides for the posting of <br />the proper signage, however, the homeowners would have discretion. He stated <br />the process would be complaint driven. <br /> <br />Council member Brown asked what process would be followed with respect to <br />door-to-door campaigning for office. Chief Goodman noted only complaints will <br />be dealt with. He stated there is a lot of discretion given to the officers, and <br />generally, five warnings are given for every one citation written. <br /> <br />Council member Marsella requested an exemption for City youth groups. <br /> <br />Council member Muckle voiced his support of the Police Department, but had <br />concerns over the overly broad nature of the ordinance. He proposed the <br />ordinance be revised to eliminate Section 5.06.030. He also questioned the pre- <br />payment clause referred to in the Staff memo, which did not appear in the <br />ordinance. City Attorney Light stated the pre-payment clause is in Subsection A. <br /> <br />Chief Goodman recommended the section pertaining to commercial sale not be <br />altered. <br /> <br />Council member Muckle asked if a school group selling newspapers as a fund <br />raiser would be in violation. Chief Goodman stated that would fall under the non- <br />profit section. <br /> <br />Mayor Sisk explained the issue is the groups from outside Louisville who solicit in <br />the City. He reported on numerous complaints about flyers and other materials <br />left on doors of homes and businesses. He asked if there is any provision for <br />licensing such activities. Chief Goodman stated the proposed ordinance does not <br />cover licensing for flyers or other materials. <br /> <br />Council member Muckle asked what section of the ordinance would address <br />
