City Attorney Light explained that provision is <br />covered under Subsection D. <br /> <br />Council member Muckle asked Chief Goodman what course of action should a <br />resident take when they are solicited by a fraudulent non-profit organization. <br />Chief Goodman stated in that case, a complaint would have to be made. <br /> <br />City Attorney Light explained the process of investigating an organization through <br />the Secretary of State's office. <br /> <br />Mayor Sisk requested public comment and hearing none, closed the public <br />hearing. <br /> <br />City Attorney Light reviewed Council's requested changes to the ordinance. <br />Page 2, Subsection B -the language would be the same if exemptions were <br />extended to the groups found in Subsection D. The language in Subsection B <br />would be as follows: <br /> <br />. Subsection A of this section and section 5 .06.030 of this chapter shall not <br />apply to bona fide religious, charitable, school and civic organizations and <br />or other organizations eligible for exemption under Section 501 (c) (3) of <br />the Internal Revenue Code. <br /> <br />The language in Subsection D would be as follows: <br /> <br />. Subsection D: Section A and section 5.06.030 of this chapter shall not <br />apply to any person engaged in distribution of non-commercial information <br />in the exercise of such person's First Amendment rights under the United <br />States Constitution. <br /> <br />Council member Sackett requested that Ordinance No. 1481, Series be <br />continued to the next meeting, so all the requested changes could be made. <br /> <br />MOTION: Council member Sackett moved that Council continue Ordinance No. <br />1481, to December 20,2005. There was no second to the motion. <br /> <br />Mayor Pro Tem Brown stated he had an understanding of the proposed revisions <br />and did not feel continuing the ordinance was necessary. <br /> <br />MOTION: Council member Marsella moved for Council approval of Ordinance <br />No. 1481, Series 2005, with revisions as outlined by the City Attorney. The <br />motion was seconded by Council member Muckle. Roll call vote was taken. The <br />motion carried by a vote of 7-0. <br />
