<br />City Council <br />Meeting Minutes <br />December 6, 2005 <br />Page 9 of 16 <br /> <br />Traffic: The change to a retail land use has the potential to increase traffic <br />generation into and out of the site. At the City's request, the applicant provided <br />traffic analyses relative to the proposed change in land use, which shows the <br />change in use will not likely have a significant impact on overall traffic volumes <br />on adjacent streets; however, it could have an increase in traffic volumes at the <br />private entries and exits into the site. Staff believes modification to the median <br />landscaping and other design modifications are necessary to mitigate this safety <br />concern, and the applicant concurs. Staff recommends the issue be resolved <br />throughthe Public Works Department prior to City Council's action on this GDP <br />amendment. The resolution includes a condition requiring additional review on <br />traffic safety concerns at the time of a change in use, with the potential of design <br />modifications as determined necessary by the City. <br /> <br />The Planning Commission held a public hearing on the application on November <br />10, 2005, and by a vote of 2 - 3, failed to pass a recommendation of approval to <br />Council. The Commission discussion focused on potential automobile fueling <br />station. Their concern was for both the aesthetics of having that type of <br />commercial use at a very visible site, and the potential traffic safety issues <br />associated with traffic volumes with that type of a change in use. <br /> <br />On previous occasions, the Amended and Restated Development Agreement <br />has been used as a mechanism for controlling specific land uses. Previous <br />amendments have required Special Review Use authorization be obtained for <br />specific land uses. Parcel H, which includes various hotels on Dillon Road as well <br />as Kinkos, Outback, Ink Coffee, etc. allows restaurant and retail uses only with <br />SRU approval. The City Council may feel it appropriate to further regulate or <br />restrict permissible specific land uses on this parcel. <br /> <br />Planning Director Wood stated the Applicant is represented by Mr. Walter <br />Koelbel and Jeffrey G. Sheets. <br /> <br />Mayor Sisk requested an Applicant presentation. <br /> <br />Walter A. Koelbel, Jr., President of Koelbel and Company, 5291 E. Yale Avenue, <br />Denver, CO, stated their request is for the reallocation of the densities and land <br />uses. He explained the Planning Commission's negative 3-2 vote was based on <br />the fueling station. He supported the conditions outlined by the City Staff. He <br />reviewed their proposal through photographs and conceptual aerial photographs <br />of the site. <br /> <br />Mayor Sisk requested public comment.
