<br />City Council <br />Meeting Minutes <br />December 6, 2005 <br />Page 10 of 16 <br /> <br />Mr. Koelbel confirmed it is. <br /> <br />Mayor Pro Tem Brown asked about the traffic issues. Planning Director Wood <br />stated the Public Works Department will review and make recommendations on <br />the traffic mitigation measures. <br /> <br />Mayor Pro Tem Brown asked if the surrounding tenants have commented on a <br />fueling station. Planning Director Wood stated no specific use has been <br />discussed with this request. <br /> <br />Mayor Pro Tem Brown concurred with the Special Review Use Process. <br />Planning Director Wood stated a Special Review Use Process (SRU) is not <br />addressed in the resolution. <br /> <br />Mayor Pro Tem Brown asked Mr. Koelbel what his views were on the SRU. Mr. <br />Koelbel stated the commercial guidelines are in place. Planning Director Wood <br />stated the SRU Criteria would be applicable for traffic mitigation measures. He <br />noted the commercial guidelines also include criteria. <br /> <br />Mayor Pro Tem Brown asked Finance Director Leslie to address the sales tax <br />opportunity or benefit to the City on a fueling station. Finance Director Leslie <br />explained the state would collect the tax of fuel sold, and the City would collect <br />sales tax on convenience store sales. <br /> <br />Council member Marsella voiced her support of the retail and concurred with <br />Mayor Pro Tem Brown a SRU application may be appropriate. <br /> <br />Council member Muckle also voiced his support for additional commercial <br />development, but had concerns over the lack of sales tax revenue generated with <br />a refueling station. <br /> <br />Mayor Sisk voiced his concern over a refueling station in a gateway to the City of <br />Louisville. He supported commercial development to the area and a change in <br />the zoning to allow more retail. <br /> <br />Council member Yarnell asked who would pay for the site improvements. Mr. <br />Koelbel confirmed Koelbel and Company would pay for the site improvements. <br /> <br />For the benefit of Council, City Attorney Light reviewed the criteria of the Special <br />Review Use. <br /> <br />Mr. Koelbel commented they propose to bring forward a plan that would be <br />acceptable to the City Council. <br />
