F. Records of inspection are to be maintained on site with the SWMP <br /> and are to be available to the city inspector upon request. <br /> Section 10. Section 13.36.150 of the Louisville Municipal Code is hereby <br /> amended to read as follows (words added are underlined; words deleted are stricken <br /> through): <br /> Sec. 13.36.150. Technical standards and specifications. <br /> All BMPs designed to meet the requirements of this chapter shall <br /> generally comply with the Urban Drainage and Flood Control District's Urban <br /> Storm Drainage Criteria Manual-volume 3-BMP or its successor, and any other <br /> alternative methodology, which is demonstrated to be effective and approved by <br /> the city. <br /> Section 11. Subsection A of Section 13.36.160 of the Louisville Municipal <br /> Code is hereby amended to read as follows (words added are underlined; words deleted <br /> are stricken through): <br /> Sec. 13.36.160. Post construction requirement of permanent BMPs. <br /> A. Permanent BMPs. Land development projects that disturb greater <br /> than or equal to one acre, including projects less than one acre that are part of a <br /> larger common plan of development subject to this chapter must address <br /> stormwater runoff quality through the use of permanent BMPs which shall be <br /> maintained in perpetuity. <br /> 1. Nonstructural BMPs (source controls) practices that prevent <br /> pollution by reducing potential pollutants at their source before <br /> they come into contact with stormwater. <br /> 24-. Structural BMPs, (treatment controls) include, but not limited to, <br /> detention and retention ponds, infiltration basins, engineered <br /> sedimentation and pollutant removal facilities that are designed to <br /> remove pollutants already present in stormwater. d <br /> inlets, BMP's located on private property shall be owned and <br /> operated by the owner of the property on which the BMP is <br /> located, unless the city in writing agrees that a person other than <br /> the owner shall own or operate such BMP. <br /> 32. As a condition of approval of the BMP, the owner shall also agree <br /> to maintain the BMP to its design capacity unless or until the city <br /> relieves the property owner of that responsibility in writing. The <br /> obligation to maintain the BMP shall be memorialized on the <br /> Ordinance No. 1623,Series 2012 <br /> Page 13 of 17 <br />
