RESOLUTION NO. 62 SERIES 2012 A RESOLUTION APPROVING AN AMENDMENT TO THE SOUTH BOULDER ROAD OPEN SPACE PURCHASE INTERGOVERNMENTAL AGREEMENT WHEREAS, the City of Louisville, City of Lafayette, and County of Boulder (the "Parties ") are parties to that certain South Boulder Road Open Space Purchase Intergovernmental Agreement dated April 29, 1993 (the "IGA "); and WHEREAS, the Parties entered into the IGA pursuant to Sections 29 -20 -101, et seq., C.R.S., to purchase certain land described therein (the "Property "), which the Parties designated to remain as open space for the purpose of preserving a community buffer in the economic and civic interest of their citizens and which land meets the goals of the Boulder County Comprehensive Plan; and WHEREAS, the IGA governs the acquisition, use and development of the Property, and Paragraph 3(b) of the IGA provides that Louisville and Lafayette may each utilize a maximum of twenty -four (24) acres on the Property for the development of athletic fields and similar development, and the necessary appurtenances thereto; and WHEREAS, Louisville has constructed the Louisville Sports Complex on a portion of the Property, and Lafayette desires to exercise its right in Paragraph 3(b) of the IGA to develop land in order to construct athletic fields and additional parking; and WHEREAS, the Parties desire to amend the IGA to address the details associated with the exercise of Lafayette's option per Subparagraph 3(b), and there has been proposed an amendment to the IGA for such purpose (the "Amendment "), a copy of which is attached hereto; and WHEREAS, the City Council by this Resolution desires to approve the Amendment and authorize its execution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The proposed Amendment to South Boulder Road Open Space Purchase Intergovernmental Agreement (the "Amendment "), a copy of which is attached hereto and incorporated herein by this reference, is hereby approved. Section 2. The Mayor is hereby authorized to execute the attached Amendment on behalf of the City Council of the City of Louisville; provided, however, that the Mayor is hereby further authorized to negotiate and approve such revisions to the Amendment as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of such Amendment are not altered.
