RESOLUTION NO. 62 <br />SERIES 2012 <br />A RESOLUTION APPROVING AN AMENDMENT TO THE SOUTH BOULDER ROAD <br />OPEN SPACE PURCHASE INTERGOVERNMENTAL AGREEMENT <br />WHEREAS, the City of Louisville, City of Lafayette, and County of Boulder (the <br />"Parties ") are parties to that certain South Boulder Road Open Space Purchase Intergovernmental <br />Agreement dated April 29, 1993 (the "IGA "); and <br />WHEREAS, the Parties entered into the IGA pursuant to Sections 29 -20 -101, et seq., <br />C.R.S., to purchase certain land described therein (the "Property "), which the Parties designated <br />to remain as open space for the purpose of preserving a community buffer in the economic and <br />civic interest of their citizens and which land meets the goals of the Boulder County <br />Comprehensive Plan; and <br />WHEREAS, the IGA governs the acquisition, use and development of the Property, and <br />Paragraph 3(b) of the IGA provides that Louisville and Lafayette may each utilize a maximum of <br />twenty -four (24) acres on the Property for the development of athletic fields and similar <br />development, and the necessary appurtenances thereto; and <br />WHEREAS, Louisville has constructed the Louisville Sports Complex on a portion of <br />the Property, and Lafayette desires to exercise its right in Paragraph 3(b) of the IGA to develop <br />land in order to construct athletic fields and additional parking; and <br />WHEREAS, the Parties desire to amend the IGA to address the details associated with <br />the exercise of Lafayette's option per Subparagraph 3(b), and there has been proposed an <br />amendment to the IGA for such purpose (the "Amendment "), a copy of which is attached hereto; <br />and <br />WHEREAS, the City Council by this Resolution desires to approve the Amendment and <br />authorize its execution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. The proposed Amendment to South Boulder Road Open Space Purchase <br />Intergovernmental Agreement (the "Amendment "), a copy of which is attached hereto and <br />incorporated herein by this reference, is hereby approved. <br />Section 2. The Mayor is hereby authorized to execute the attached Amendment on <br />behalf of the City Council of the City of Louisville; provided, however, that the Mayor is hereby <br />further authorized to negotiate and approve such revisions to the Amendment as the Mayor <br />determines are necessary or desirable for the protection of the City, so long as the essential terms <br />and conditions of such Amendment are not altered. <br />Resolution No. 62, Series 2012 <br />Page 1 of 2 <br />
