RESOLUTION NO. 39 <br />SERIES 2014 <br />A RESOLUTION APPROVING THE LAFAYETTE/LOUISVILLE BUFFER <br />COMPREHENSIVE DEVELOPMENT PLAN INTERGOVERNMENTAL AGREEMENT <br />(2014 EXTENSION) <br />WHEREAS, the City of Louisville, City of Lafayette and County of Boulder ( "the Parties ") <br />entered into the Lafayette/Louisville Buffer Comprehensive Development Plan Intergovernmental <br />Agreement ( "Original Agreement "), effective the 9th of July, 1996; and <br />WHEREAS, the Original Agreement was amended through the First Amendment to <br />Lafayette/Louisville Buffer Comprehensive Development Plan Intergovernmental Agreement, <br />effective February 1997, and again in July 1999, through the Second Amendment to <br />Lafayette/Louisville Buffer Comprehensive Development Plan Intergovernmental Agreement (the <br />"First and Second Amendments "); and <br />WHEREAS, unless extended, the Original Agreement would expire by its terms on July 9, <br />2016; and <br />WHEREAS, the Parties desire to extend and amend the Original Agreement, as it has been <br />amended by the First and Second Amendments, until July 9, 2036; and <br />WHEREAS, for such purpose there has been proposed the Lafayette/Louisville Buffer <br />Comprehensive Development Plan Intergovernmental Agreement (2014 Extension) (the <br />"Agreement" or "2014 Extension "), by which the Parties also desire to account for changes to the <br />status of certain parcels subject to the Original Agreement, as amended; to update the terms of the <br />Parties' agreement; and to update the Map portion of the Agreement accordingly; and <br />WHEREAS, in order to clarify in a single document the terms of the Parties' agreement, <br />the Parties desire to supersede and replace all prior agreements, consisting of the Original <br />Agreement and the First and Second Amendments, with the 2014 Extension and encompass in the <br />2014 Extension the entirety of the Parties' agreement; and <br />WHEREAS, § 29 -20 -101 et seq., C.R.S. as amended, enables the Parties to enter into <br />intergovernmental agreements to plan for and regulate land uses, in order to minimize the negative <br />impacts on the surrounding areas and protect the environment, and specifically authorizes local <br />governments to cooperate and contract with each other for the purpose of planning and regulating <br />the development of land by means of a "comprehensive development plan;" and <br />WHEREAS, in order to continue to ensure that the unique and individual characters of <br />Lafayette and Louisville, respectively, are preserved, the City Council believes that a <br />comprehensive development plan which recognizes the annexed areas and development approved <br />Resolution No. 39, Series 2014 <br />Page 1 of 3 <br />
