�n 1 1111 111111 <br />06/23 2014 12 02 PM <br />Boulder County Clerk, CO <br />AMENDMENT TO SOUTH BOULDER ROAD OPEN SPACE PURCHASE <br />INTERGOVERNMENTAL AGREEMENT <br />03381574 <br />Page: 1 of 8 <br />DF: $0.00 <br />THIS AMENDMENT to the South Boulder Road Open Space Purchase <br />Intergovernmental Agreement with an original effective date of April 29, 1993 ( "IGA "), by and <br />between the City of Lafayette, Colorado, a home -rule municipal corporation ( "Lafayette"), the <br />City of Louisville, a home -rule municipal corporation ( "Louisville "), and the County of Boulder, <br />a body politic and corporate of the State of Colorado ( "Boulder County ") (collectively, "the <br />Parties "), is entered into and made to be effective on the latest date as set out on the signature <br />page of this Amendment. <br />RECITALS <br />WHEREAS, in April 1993, the Parties entered into the IGA, pursuant to Sections 29 -20- <br />101, et seq., C.R.S., to purchase certain land described therein (the "Property"), which the Parties <br />designated to remain as open space for the purpose of preserving a community buffer in the <br />economic and civic interest of their citizens and which land meets the goals of the Boulder <br />County Comprehensive Plan; and <br />WHEREAS, the IGA was adopted by the Parties as the "South Boulder Road Open Space <br />Purchase" which governs the acquisition, use and development of the Property; and <br />WHEREAS, Paragraph 3(b) of the IGA provides that Louisville and Lafayette may each <br />utilize a nfaximum of twenty -four (24) acres on the Property for the development of athletic <br />fields and similar development, and the necessary appurtenances thereto; and <br />WHEREAS, Louisville has constructed four (4) softball fields, a parking lot, scoreboard, <br />and restrooms on a portion of Parcel 1 of the Property ( "Louisville Ball Fields "); and <br />WHEREAS, Lafayette desires to exercise its right in Paragraph 3(b) of the IGA to <br />develop the land in order to construct athletic fields and additional parking; and <br />WHEREAS, the Parties desire to amend the IGA to address the details associated with <br />the exercise of Lafayette's option per Subparagraph 3(b); and <br />WHEREAS, the Parties have each held hearings after proper public notice for the <br />consideration of entering into this Amendment as may be required by law. <br />NOW THEREFORE, in consideration of the above and mutual covenants made herein, <br />the Parties agree as follows: <br />1.
