�n 1 1111 111111 06/23 2014 12 02 PM Boulder County Clerk, CO AMENDMENT TO SOUTH BOULDER ROAD OPEN SPACE PURCHASE INTERGOVERNMENTAL AGREEMENT 03381574 Page: 1 of 8 DF: $0.00 THIS AMENDMENT to the South Boulder Road Open Space Purchase Intergovernmental Agreement with an original effective date of April 29, 1993 ( "IGA "), by and between the City of Lafayette, Colorado, a home -rule municipal corporation ( "Lafayette"), the City of Louisville, a home -rule municipal corporation ( "Louisville "), and the County of Boulder, a body politic and corporate of the State of Colorado ( "Boulder County ") (collectively, "the Parties "), is entered into and made to be effective on the latest date as set out on the signature page of this Amendment. RECITALS WHEREAS, in April 1993, the Parties entered into the IGA, pursuant to Sections 29 -20- 101, et seq., C.R.S., to purchase certain land described therein (the "Property"), which the Parties designated to remain as open space for the purpose of preserving a community buffer in the economic and civic interest of their citizens and which land meets the goals of the Boulder County Comprehensive Plan; and WHEREAS, the IGA was adopted by the Parties as the "South Boulder Road Open Space Purchase" which governs the acquisition, use and development of the Property; and WHEREAS, Paragraph 3(b) of the IGA provides that Louisville and Lafayette may each utilize a nfaximum of twenty -four (24) acres on the Property for the development of athletic fields and similar development, and the necessary appurtenances thereto; and WHEREAS, Louisville has constructed four (4) softball fields, a parking lot, scoreboard, and restrooms on a portion of Parcel 1 of the Property ( "Louisville Ball Fields "); and WHEREAS, Lafayette desires to exercise its right in Paragraph 3(b) of the IGA to develop the land in order to construct athletic fields and additional parking; and WHEREAS, the Parties desire to amend the IGA to address the details associated with the exercise of Lafayette's option per Subparagraph 3(b); and WHEREAS, the Parties have each held hearings after proper public notice for the consideration of entering into this Amendment as may be required by law. NOW THEREFORE, in consideration of the above and mutual covenants made herein, the Parties agree as follows: 1.
